【摘要】 绿色金融制度在全球经济可持续发展中起着非常重要的作用,是未来全球经济向着绿色增长模式发展的有力保障措施之一,不但能促使全球经济的快速发展,还能有效保护人类所居住的生态环境。绿色金融制度是在全球绿色经济迅速发展的基础上兴起的,其产生目的是利用金融手段保护生态环境和优化经济增长。为达到经济的可持续发展、人类发展的代际公平以及人与自然的和谐发展,世界各国在绿色金融制度发展上积极探索。目前,美国已建立起比较完善的绿色金融制度体系,主要包括美国联邦政府与州政府制定的相应绿色金融法律、法规。该制度体系是在美国传统环境保护法基础上结合美国国内经济发展与环境保护的实情而构建的,对落实美国金融机构、产业部门、美国市场和公民个人等主体的绿色金融制度实行起到强有力的法律约束力。绿色金融制度的实施,本质上是为了将经济发展和环境保护有效的结合起来。为促使美国绿色金融发展能在全球处于领先地位,美国政府通过一系列的财政、税收等激励措施将绿色金融制度在上述提到的各社会主体中推行实施,并取得了比较有成效的效应,包括社会效应、经济效应和环境效应,对促进美国经济发展、提高美国就业率、缓解美国能源紧缺、控制美国环境污染起到了切实有效的作用。我国作为一个正在崛起的经济大国,发展绿色金融成为必选之道。目前,我国在绿色金融发展上取得了一定的成就,绿色金融制度构建上也有所涉及。同时,我国一些政府部门、相关机构以及公民个人对绿色金融发展的最新实践与探索也正在有序的进行中。但是由于我国绿色金融发展还不够健全、绿色金融制度还存在一定的缺陷,因此有必要借鉴美国的先进经验,以此来改善我国在绿色金融制度发展中存在的不足,建立起专门的绿色金融法律体系。更多还原

【Abstract】 Green financial system is playing a very important role in global economic sustainable development, and it’s a powerful safeguard measures of future global economic growth which growing with green increase pattern. The green financial system not only can contribute to global rapid economic development, also can effectively protect the ecological environment of human lives. Green financial system was rapidly extended in the world under the push of green economic development. The goal of the system is to use financial means to protect the ecological environment and to optimize economic growth. To achieve economic sustainable development, intergenerational environmental equity and harmonious development between human and nature, nations are probing the development model of green financial system.At present, United States has established comparatively perfect green financial system, including green financial laws and regulations of American federal government and state governments. This system was based on the United States traditional environmental protection law, which reflects the actual situation of American domestic economic development and environmental protection. It plays powerful legally binding to comply the U. S. financial departments, manufacturing enterprises, American market and individual citizens with the green financial system.In essence, Green financial system’s implementation bands together the economic development and environment protection effective. For leading global green financial development, the U.S. governments adopt a series of finance and tax incentives to carry out the system. These incentives made quite effective effect include social effect, economic effect, and environmental effect. All these play a practical and effective role on promoting economic development, improving employment rate, easing energy shortage, and controlling the environmental pollution of American.As a rising economic powers, developing green financial appear particularly important to China. At present, China has been made fairly progress in green financial development and green financial system construction. Meanwhile, the government, related institutions and individuals are practicing and exploring the latest trends of green finance. However, because Chinese green financial development is insufficient, green financial system still exist shortcomings, it is necessary to learn from the advanced experience of the United States to perfect the blemishes of Chinese green financial system, so that to establish special green financial legal system.更多还原
