我国不动产错误登记赔偿责任研究

【摘要】 不动产错误登记赔偿制度是一项重要的物权法制度,在物权法体系乃至整个民法体系中具有重要的地位。对于该制度的理解与把握涉及对整个物权法甚至整个民法基础价值的考究。因此,理论与实践意义重大。但2007年3月16日颁布的《物权法》,只是对不动产物权错误登记赔偿制度一般性的内容进行了规范,对这种赔偿的性质以及归责原则等重大制度都未有明确的规定。理论界对此的认识更是纷繁复杂。本文共分四部分:第一部分,通过引用不动产错误登记的法律规定等,评析不动产错误登记规定的不足,着重对不动产错误登记赔偿责任的行政责任性质进行了批判。认为不动产错误登记的赔偿责任性质为民事赔偿责任。第二部分,在上述基础上,探讨了不动产错误登记的归责原则及其构成要件。认为不动产错误登记的归责原则应当是过错责任原则。第三部分,在不动产错误登记赔偿的基础上,就该种赔偿责任的承担方式进行了探讨。第四部分,在上述三部分的基础上,本部分就登记机构赔偿责任的防范及赔偿金来源进行了梳理。通过以上四部分的论述,本文以为:目前,我国不动产错误登记赔偿责任制度涉及的诸多研究理论问题存有值得商榷之处,有必要对错误登记赔偿责任性质、错误登记的归责原则、构成、赔偿责任等制度进行重新梳理。

【Abstract】 Real estate error registration compensation system is an important property rights system. It has an important position in property law system and even the entire civil law system. To understand and grasp this system involved the Property law or even entire civil fundamental value fastidious. Therefore, it has important theoretical and practical significance. The "Property Law" was promulgated in March 16,2007, only provides compensation for real property registration system for the general content of organs, does not provide the nature of the Real Estate Registration for compensation and other major system such as fcriterion of liability.For this, Scholars view is complex and varied.This paper is divided into four parts:Part I. By referencing estate error registration law etc, analyzes the realty error registration regulations, and emphatically over-in-diligence lack of real estate error registration liability on the critical nature of the administrative responsibility. Thought:real estate error registration’s Nature is the civil liability to pay compensation. PartⅡ. Based on the above, discusses the realty error registration imputation principle and constituents. Thought:real estate imputation principle error registration shall be the fault liability principle.PartⅢ. On the basis of compensation, discusses the way of liability.PartⅣ.Based on the above, this part discusses the Compensation liabilities prevention and damages source.Through the above discussions, this paper argues that China’s real estate error registration liability to pay compensation system involves many research theory problems. It’s necessary to explain error registration liability to pay compensation properties, error registration imputation principle, structure, liability to pay compensation system.
