【摘要】 在广大农村,尤其是中西部农村,很多农民为了生计外出务工,进城之后,由于受户籍制度、教育制度、经济能力等因素的影响,大多选择把年幼的孩子委托给父母或其他亲戚朋友,更有甚者让他们独自留在家中,这些留守儿童由于父母不在身边,亲情监护缺失,其他监护人监护不力,这样他们的合法权益及身心健康很容易受到伤害,而且,这种情形愈演愈烈。留守儿童问题已成为一个突出的社会问题,引起了社会各界的广泛关注,不少学者提出了很多解决这一问题的方法,纵观这些方法,作者认为完善监护制度是解决这一问题的重要途径。本研究分为三个部分,第一部分,作者通过一则案例分析留守儿童形成的原因、背景以及对他们身心造成的各种影响；第二部分,主要从我国目前的监护现状进行研究,结合现行的术成年未成年监护制度来剖析留守儿童监护制度存在问题；第三部分,作者从立法上对完善农村留守儿童监护制度提出的几点建议,希望留守儿童的权益得到切实的保护。更多还原

【Abstract】 In the extensive rural areas,especially in the central and western areas of China.Many peasants migrate to the cities to search for livelihood.But after they entered the cities,most of them have to delegate their children to their old parents,the other relatives or friends,and some even live their children olone at home,due to the household registation system,the education system and the economic capacity ect.Because the parents are not around,the children left-behind always face the problems of lacking of family care,the peer care of the other persons,their lefitimate rights and the physical and mental health incline to be vulnetable,and the situation is getting worse day by day.The problem of the children left-behind has become a prominent one,so many scholors put forward to solve this problem.By investigating these methods,the anthor considers that perfect the system of monitoring is an important way to solve the problem.The paper is divided into three parts.The first part analyzes the causes of the formation and background of the phenominon of the children left-behind,and illustrate the impacr on the children’s physical and mental problems caused by the phenominon.The second part focuses on the research of the guardianship,combined with the current monitoring system to invstigate the problems of existing monitoring system.The third part,the author proposes some suggestions on the improvement of the legislation of the guardianship of the rural children left-behind,and expects the better protection of the rights and interests of the children left-behind.更多还原
