【摘要】 随着经济全球化和知识产权经济的发展,围绕知识产权资源的运用,国内外开展了大量的研究,在社会实践中,发达国家知识产权保护机制已经日趋严格,知识产权发展模式也渐渐明朗,从世界经济一体化的现实来看,拥有知识产权的国家之间的博弈、联合与合作已成为一种趋势,但是发达国家却主导了现行的世界知识产权秩序,对发展中国家进行打压,一定程度上造成发展中国家的被动,打破各个国家独立发展的思维方式,确立区域协调、互动发展已是时代的要求。然而理论研究中,还没有建立相关的知识产权保护机制与模式的体系和框架,对知识产权发展机制与模式研究还停留在表面,没有深入的研究,尤其是没有进行系统化、站在国家经济安全的角度、运用多学科综合研究方法,因此,还有很大的研究空间。本文站在前人研究的基础上,加以深入研究,在研究角度上,立足于国家经济安全,尤其是开放条件下的国家经济安全角度,可以为文章的研究带来新的视野；采用研读最新文献、知识产权相关数据以及实地调研等方法获取最新的材料,以使研究具有适用性；研究方法上,主要运用了法经济学和博弈论的思想,试图从知识产权与经济关系协调发展的角度出发,贯穿效率与公平的理念,并积极寻求交易各方的行动策略选择模式,最终得出的结论主要有：中国政府除应适时调整知识产权政策以外,还必须引入市场机制对知识产权进行合理有效的配置,倡导区际开放,加强经济合作,促进共同发展；以中国的知识产权与经济发展为主线,提出了在知识产权促进中国经济发展的战略背景下实现中国知识产权和谐发展的制度、资金、效益等的保障,从而有效建立中国在开放条件下的知识产权发展理论、机制与模式选择体系。更多还原

【Abstract】 With economic globalization and economic development of intellectual property, intellectual property rights surrounding the use of resources, a lot of research carried out abroad, in social practice, the developed countries have been increasingly stringent intellectual property protection mechanisms, intellectual property development model will become clearer, reality from the perspective of world economic integration, with the game between the countries of intellectual property rights, combined with the cooperation has become a trend, but developed countries have dominated the existing order of world intellectual property rights on developing countries to suppress, we must extent, caused by developing countries, the passive, the independent development of various countries to break the way of thinking, to establish regional coordination, interactive development is the times. However, in theory, there is no establishment of relevant mechanisms and modes of intellectual property protection system and framework, mechanism and mode of development of intellectual property research also stay on the surface, there is no in-depth research, in particular no systematic, our national economy safety point of view, multi-disciplinary research methods used, so there is still much research space.This stood on the basis of previous studies, to in-depth study, the research point of view, based on national economic security, especially in open country under the conditions of economic security perspective, the research for the article to bring a new perspective; by reading the latest literature, intellectual property and other related data and field research methods to obtain the latest materials to make the study of applicability; research methods, the main use of the law and economics and game theory, the idea of trying to coordinate the development of intellectual property and economic relations point of view proceed through the concept of efficiency and equity and is actively seeking strategic options for action parties to the transaction model,the final conclusions are:the Chinese government should adjust the policy of intellectual property rights other than the introduction of market mechanisms must also be reasonable for intellectual property valid configuration, inter-district open advocacy, to strengthen economic cooperation and promote common development; to China’s intellectual property and economic development as the main line, put forward China’s economic development in the IP for the strategic background to achieve the harmonious development of China’s intellectual property system funds, effectiveness of protection, effectively under the conditions of establishment of China’s intellectual property in the open development theory, mechanism and mode selection.更多还原
