论我国票据质押法律规则之冲突及其调整之思维进路

【摘要】 本文主要内容共分为四章。第一章介绍“我国票据质押法律规则及其内在冲突”。这章介绍了票据质押的发展历史和基本法律属性,具体分析了我国票据质押法律规则存在冲突的具体冲突表现,提出了本文需要解决的问题“票据质押法律规则冲突的调整”。在问题提出后,本文的第二章对“票据质押法律规则中的冲突产生之原因”从法律体系定位、立法价值取向、票据质押本身的特性以及立法技术原因的方面进行了的分析。原因分析之后,本文的第三章提出“我国票据质押法律规则中的冲突之化解可能”,从应然(法哲学)和实然(具体实践)两个角度分析我国的票据质押法律规则的冲突具有化解的可能。本文的第四章就“我国票据质押法律规则中的冲突之化解路径”提出了作者自己的解决思路,在分析已有的解决思路的基础上,提出了选择解决思路的标准,并从本文提出的票据质押双重法律属性的角度提出了在立法和司法两个方面化解票据质押法律规则冲突的具体意见。更多还原

【Abstract】 This article is divided into four chapters. The chapter I contains the pledge rules of bills in laws of china and the conflict between them. This chapter provides the history and basic legal nature of bill pledge, the detail analysis of the conflicts between articles about bill pledge and the issue how to adjust the conflict. In chapterⅡ, the author analyses the reasons from the aspects of the bill pledge’s position in the legal system, the legislative value, the characters of bill pledge, legislative technology and so on. The chapterⅢprovides the possible ways to solve the issue from views of the sollen(jurisprudence) and the solid. The chapterⅣis talking about the path to solve the conflict between articles about bill pledge in the author’s view. In this chapter, basing on analyzing existed ways to solve the issue, the author provides the standard on making a choice from the ways, and gives the specific opinions to solve the be conflict in legislation and justice from the double legal attributes of bill pledge.更多还原
