【摘要】 信息时代的到来,极大地影响了人们的生活方式。人们足不出户就可以获取丰富的信息,享受便捷的生活。电子数据库已成为与计算机、通讯技术并称的信息社会的三大支柱。为了促进信息产业的发展、保障投资者的权益,必须加强对数据库的法律保护。利用著作权保护数据库已成定论,世界上许多国家和国际公约及区域性协定对此都作了规定。我国数据库著作权保护,是将数据库作为汇编作品予以保护。为适应我国数据库保护的现实需要,2001年对《著作权法》进行了修正,将由不构成作品的材料或数据汇编而成的数据库也纳入著作权法保护的范围,这一规定与《TRIPS协议》和《WCT》等国际条约的相关规定进一步接轨。数据库作为智力创作成果,利用著作权法予以保护有利于实现权利人个体利益与社会公共利益的平衡。著作权法保护数据库的独创性表达,最终是通过保护数据库具有独创性设计的数据库结构和独创性选择的数据库整体内容来实现的,而且,这种保护是将数据库作为一个整体进行的。本文系统研究了数据库著作权法保护的基本理论,深入分析了数据库著作权法保护存在的问题,在此基础上提出了完善我国数据库法律保护的立法建议。围绕上述脉络,本文分为三个部分:第一部分,从数据库的定义入手,阐述了数据库的特征、分类以及对数据库予以法律保护的必要性。接下来介绍了国外数据库著作权保护立法概况以及我国数据库著作权保护的历史与现状。第二部分,探讨数据库著作权保护的具体内容以及数据库著作权保护的困境,比如在著作权保护范围较窄及保护力度偏低、选择和编排的独创性难以把握、独创性与实用性之间存在矛盾、保护期限过长等问题。第三部分,综合上述分析,提出完善我国数据库法律保护的立法建议。一是暂缓实行数据库特殊权利保护制度。二是完善现有数据库著作权法保护制度,包括确立数据库的内涵与外延及其法律地位、适当降低数据库独创性判断标准、合理规定保护期限以及完善权利限制等内容。三是建立以著作权法保护为主的综合保护体系,对数据库提供更加灵活而全面的保护。更多还原

【Abstract】 The incoming of Age Information has changed people’s lifestyle. The development of databases brings convenience, people even can obtain abundant information at home. The electronic database has been one of the three pillar industries of information society together with computer and communication technology. To promote the development of information industry and to ensure the interests of investors, it is necessary to strength the legal protection of database.Protecting databases under copyright law has become a conclusion and many countries and international conventions and regional agreements make provision to it. Database protection under our copyright law is to protect database as a compilation work. In order to meet the needs of database protection in our country, we revised the“Copyright Law”in 2001 year, making the database made of material or data which does not constitute a work to the copyright protection scope. This provision made the further integration to the relevant provisions of international treaties such as the "TRIPS Agreement" and "WCT ". Using copyright law to protect database, which is as intellectual creation, contributes to counterpoise the rights of producer’s individual interests and public interests. Copyright law protects creative expression of a database through protecting the ingenious design of the database structure and original choice of overall content of the database. Moreover, the protection is carried out in the database as a whole.The thesis makes a systematical study of basic theory on database copyright protection, and analyses the problems on database copyright protection, and gives legislative proposals to perfect the legal protection of database. With the above context, the thesis is divided into three parts.First part starts form the definition of database. The author mainly demonstrates the features, classification and the necessity of legal protection to database. Then the author introduces the copyright protection legislations status about database at abroad, as well as history and the present status of database copyright protection in China.Second part investigates the details of database copyright protection, and the dilemma of database copyright protection, such as the small scope of the protection object and the low intensity of the protection, and the trouble to grasp the originality of selection or arrangement, and the contradiction between originality and practical, and the long protection period, and so on.Third part points out the legal suggestions of perfecting database legal protection in China after above analysis. Firstly, it should suspend to carry out the Sui Generis Right. Secondly, it should perfect the existing copyright protection system for database, which includes making a clear definition of database and establishing the legal status of database, and appropriating to reduce the database originality criterion, and stipulating proper protection period of database, and making more reasonable exception to the copyright of database. Thirdly, it should establish a general protection system which makes the copyright protection as the main content, to support a more comprehensive and flexible protection.更多还原
