比较法视野中的我国环境法法典化

【摘要】 法典化理念在环境法领域逐渐兴起,针对欧陆环境法典进行比较研究,有益于环境法法典化在中国的展开。在形式编纂与实质编纂之间,中国环境法典应当选择适度法典化作为目标定位,并以法典体系效益为纲,从确定性、稳定性与开放性三个维度予以具体展开。确定性维度要求对环境法典的调整范围予以明确,我国环境法典应当综合考量比较法上所呈现出的划界依据并具体分析特殊规范的法域归属。法典边界划分产生了内外两部分规范体系。比照欧陆环境法典在内部体例上所普遍遵循的论理体,我国环境法典的稳定性取决于总则的抽象性程度与分则的编排逻辑。环境法典还需对其外部留存的环境法渊源保持一定的开放性以实现自身的更新与进化,正视与环境单行法的关系以回应解法典化的质疑,同时联系其他相关部门法以形成法律合力。

【Abstract】 The idea of codification has gradually emerged in the field of environmental law.A comparative study on the Environmental Code is conducive to the codification of environmental law in China.Between formal codification and substantive codification,Chinese Environmental Code should choose moderate codification as the objective orientation,and unfold it through the three dimensions of certainty,stability and openness from the perspective of systematic benefits of the code.The certainty dimension appeals to the clarification of the scope of environmental code.China should comprehensively consider the demarcation basis presented in the comparative law and carefully select certain legislations into the environmental code.The boundary of code divides environmental norms into the internal and the external systems.Given the academism style generally followed by the European Environmental Codes,the stability of environmental code depends on the abstraction of the general part and the logic of specific parts.The environmental code also needs to maintain a certain degree of openness to the external sources of environmental law for its renewal and evolution,by managing the relationship with environmental special laws in response to the challenge of the Decodification and coordinating with relevant branches of law to achieve legal synergy.
