【摘要】 随着我国近些年来所面临的环境污染问题越来越突出,环境侵权理论的研究也愈发成为热点,在环境侵权领域,经常出现数人共同实施侵权行为的状况。数人环境侵权在大多数情况下侵权人之间并没有意思的联络,对于无意思联络情况下的数人环境侵权行为,数人之间对外责任究竟应该如何分担这一问题长期困扰着理论界与实务界。以类型化为主要研究手段先对无意思联络情况下的多数人环境侵权行为进行归类,将其划分为:环境聚合危害行为、环境加算危害行为、环境择一危害行为以及环境叠加危害行为。再依据各类型侵害行为自身的特征分别确定其责任的承担方式:环境聚合危害行为中各行为人对于受害人应当承担连带责任;环境加算危害行为中各行为人对于环境侵权受害者承担相应的按份责任;环境择一危害行为的各侵害主体对于受害人承担连带责任;环境叠加危害行为的数个侵权行为人对于受害人应当承担按份责任。依照不同之类型划分从而确定不同情况下之责任分担,以期能够廓清争议,为我国法院审理多数人环境侵权案件提供新思路。更多还原

【Abstract】 For several persons′ environmental tort without meaning connection, the question that how to assign its external liability has perplexed scholars and lawyers for a long time. To conquer this question, this article divided several persons’ environmental tort without meaning connection into several different kinds according to the causality, such as: the environmental collected damage behavior, the environmental accumulated damage behavior, the environmental chosen damage behavior and the environmental overlapped damage behavior. Afterwards, the external liability can be confirmed by the characteristic of every type’s tort for the environmental collected damage behavior, the tortfeasors should undertake the joint liability; for the environmental accumulated damage behavior, the tortfeasors should undertake the pro rata liability; for the environmental chosen damage behavior, the tortfeasors should undertake the joint liability;for the environmental overlapped damage behavior, the tortfeasors should undertake the pro rata liability.更多还原
