【摘要】 我国土壤污染修复治理主要采取以行政划界的碎片化管理,与日益凸显的环境整体性治理相矛盾。《土壤污染防治行动计划》提出探索跨行政区域的土壤污染防治联动协作机制。我国土壤污染修复治理中地方政府联动协作机制运行中存在着各区域间的合作体系层级低、法律配套欠完善、地方政府间竞争无序、资源配置不合理和地方政府协作机制权责不明等问题,需要构建"多元共治"体系,完善协作运行配套机制;发挥市场主体协调自主性,建立生态利益补偿激励机制;厘清权责关系,明确协作管理责任等优化路径。更多还原

【Abstract】 The promulgation of the Action Plan on Soil Pollution Prevention and Control in 2016 has clearly defined the importance of exploring a collaboration mechanism for soil pollution prevention and control across administrative regions. At present, the treatment and remediation of soil pollution in China highlights the conflicts and contradictions between the overall governance needs of the environment and the fragmented management of traditional administrative demarcation. Improving the collaboration mechanism of local governments is a major problem in remediation of soil pollution. This article analyzes the status quo of the local government linkage coordination mechanism on the basis of overall governance theory, discusses the problems affecting the operation of the mechanism which includes the initial stage of regional cooperation mechanism, the imperfection of various systems and regulations, the unreasonable allocation of resources caused by disorderly competition among local governments, the unclear authority and liabilities of local government cooperation mechanism, and the lack of authority, and finds a suitable approach to improve the collaboration mechanism of local government linkages in soil pollution control and restoration: Firstly, to build a "multi-governance"system and improve the supporting mechanism of cooperation; secondly, to give full play to the coordination and autonomy of market participants and improve the incentive mechanism of compensation for ecological interests; thirdly, to clarify the power-liability relationship and explore the liability sharing and reward-punishment mechanism of cooperative management.更多还原
