【摘要】 2015年《行政诉讼法》修改在第七十三条增设了一般给付判决这一内容,丰富了我国行政诉讼判决的类型,成为本次修法的亮点之一。2018年2月8日颁布实施的《最高人民法院关于适用〈中华人民共和国行政诉讼法〉的解释》用不完全列举的方式对"给付义务"加以解释,但列举规定过于狭窄,仅包含"抚恤金、最低生活保障待遇和社会保险待遇"三类,"等给付义务"的概括规定又极其宽泛。实践中一般给付判决的适用亦十分广泛:突破了司法解释明文规定的三种类型,又与履行判决和行政协议判决的适用发生了竞合和混同。当前我国一般给付判决的适用范围应当包括财产性给付、事实行为给付,一般不作为给付和预防性不作为给付,未来应进一步将请求颁布相应规范的给付行为纳入其中。更多还原

【Abstract】 In 2015,the amendment of the Administrative Procedure Law introduced the general payment judgment in article 73,which enriched the types of administrative litigation judgment in China and became one of the highlights of this revision.The Administrative Litigation Interpretation,which promulgated and implemented in February 8,2018,defined the "obligation of payment" in an Non-exhaustive enumeration.However,the list contains only three categories of "pension,minimum living security treatment and social insurance treatment",while the wording of "obligation of payment etc" is extremely broad.The application of the general payment judgment in judicial practice is extremely extensive as well,beyond the three types stipulated explicitly in the judicial interpretation,so it results in concurrence and confusion with the application of the execution judgment and the administrative agreement judgment.Under the current background,the scope of application of general payment judgment in our country should include property payment,factual act payment,stop act payment and preventive omission payment.In the future,we should further incorporate the request for promulgating of relevant norms of payment behavior into it.更多还原
