【摘要】 国家公园建设中的社区权利是社区面向国家公园建设中其他治理主体的权利,是贯穿于整个国家公园建设全过程的权利,是一种兼具"公权利"与"私权利"色彩的双重权利。国家公园建设中的社区权利可以分为行动权利和接受权利,前者主要包括知情权、评论建议权、信息发布权以及动议权等,后者主要包括接受生活扶助权、获得平等对待权、获得通知权以及获得理由权等。《中华人民共和国宪法》为我国国家公园建设中的社区权利提供了根本性规范依据,相关文件与地方立法则为国家公园建设中的社区权利提供了直接规范依据。更多还原

【Abstract】 The community rights in national parks establishment are the rights of communities dealing with other governance subjects, which run through the whole process of national park establishment. It is a dual right with the features of both "public rights" and "private rights". Community rights in national park establishment can be divided into right to act and right to accept. The right to act mainly includes the right to be informed, the right to comment and suggest, the right to release information, and the right to deliberate. The right to accept mainly includes the right to life assistance, right to be equally treated, right to notice and right to reason. The Constitution provides fundamental normative basis for community rights in national park establishment, while relevant documents and local legislation provide direct normative basis for community rights in national park establishment.更多还原
