【摘要】 新一轮土地制度改革集中在正式的集体土地产权变革层面,相对忽略了对非正式的社区土地产权的吸纳,打破了集体产权安排和社区产权安排的自然重合性。基于国家核心产粮区的田野调查发现,集体土地产权对村庄外部主体开放后,社区土地产权仍处于对外闭合状态;而对村庄内部,集体土地产权因土地流转形成闭合后,社区土地产权不仅没有同步闭合,反而因正式的资源占有渠道固化而愈加开放。无论对外抑或对内,市场化的单向度改革难以使集体产权和社区产权均衡变迁,不利于产权纠纷的解决。对此,应遵循增强农民自主决策能力、辨别基层实践优劣成分、总结社区产权安排规律等原则,充分发掘社区产权安排在农业现代化进程中的价值功能。更多还原

【Abstract】 The new land system reform focuses on the formal collective land property right and ignores the absorption of informal community land property right. In this way, the natural coincidence of collective property right arrangement and community property right arrangement was broken by the new land system reform. Based on field survey on national core grain-producing areas, this research found that after the collective property right opened to outside subject of village, the community property right was still closed. However, towards the inside of village, collective property right was closed under the influence of land circulation, the situation was not the same on community property right. The latter has become more open because of the solidification of formal resource possession channels. No matter external or internal, it’s difficult for market-oriented and one-dimensional reform to keep balance between collective property right’s change and community property right’s change, so it isn’t conducive to settling the disputes’ on land property right. Therefore, we should follow principles including strengthening peasants’ independent decision-making ability, identifying merits and demerits in grassroots practices, and summarizing rules of community property rights arrangement. Through these efforts, we can explore fully the value function of community property right arrangement in the process of agricultural modernization.更多还原
