【摘要】 世界的沟通和交流日益加深,越来越多的类似"生物剽窃"的事件发生,生物多样性相关传统知识的保护已经是迫在眉睫的问题。关于生物多样性相关传统知识既有积极的保护,也有防御性保护。由于传统知识的特殊性,仅靠积极保护并不能完全地应对现实的一些问题。从生物多样性相关传统知识的定性和防御性保护的原理出发,对传统知识的防御性保护的现实层面和法律层面进行论述,通过防御性保护的功效与积极的保护一道,来更好地保护和合理地利用生物多样性相关的传统知识。更多还原

【Abstract】 The communication and exchanges all over the world have been deepening,and more and more "biopiracy "incidents have occurred. The protection of traditional knowledge is an imminent problem. With respect to the protection of traditional knowledge,there are both positive and defensive protection. Due to the special nature of traditional knowledge,a single active protection cannot completely deal with some real problems. Starting from the principle of qualitative and negative protection of traditional knowledge,we then discuss the defensive protection of traditional knowledge at the practical level and the legal level,in the hope that the traditional knowledge can be better protected through defensive protection.更多还原
