【摘要】 2007年我国就开始了环境污染责任保险的试点工作。但时至今日,该保险的运行在我国仍然没有形成完整的体系。为了更好地促进该保险顺应我国社会现状,我国应加强完善环境污染责任保险的立法工作,在行政法规层面上确定相应的法律制度。在分析了环境污染责任保险的立法现状之后,结合其实施的可行性,设想了相关制度的构建,明确了其性质、保险法律关系的相关主体和索赔期限。更多还原

【Abstract】 It was in 2007 that China started to launch experimental work about developing environmental pollution liability insurance. Although this insurance has gone through many years, it still fails to form a complete system in our country. In order to promote it to comply with the current society, China should focus on improving its legislative work and determine the corresponding legal system at the level of administrative regulations. After analyzing the legislative condition of this insurance and combining the feasibility of its implementation, this study envisaged its constructional system by making clear of its nature, the relevant subjects in legal relations and claim period.更多还原
