【摘要】 法律监督机关的宪法定位和"互相制约"的宪法原则决定了检察机关应当对监察立案进行监督。无论是涉嫌违法抑或是涉嫌犯罪的监察立案,都应纳入立案监督的架构进行控制。不能以现有立法设定了完备的内部控制机制为由,拒绝对监察立案进行外部控制。应当借鉴对公安刑事立案监督的实践经验,针对监察立案监督权中的知情权、程序控制权和纠正调查建议权进行具体可行的构建,监察立案监督权才是立体的、有效的。更多还原

【Abstract】 The constitutional status of legal supervision organization and the constitutional principle of "restricting each other" determines that the procuratorial organizations ought to supervise the case filing procedure of supervisory organs for both duty violation case and crimes by taking advantage of duty.It is unreasonable to avoid external supervision towards the case filing procedure of supervisory organs merely with the internal hierarchical control set up in the existing legislation. By taking reference from the practical experience of public security organs’ case filing supervision system, the supervision of the case filing procedure of supervisory organs will become effective if the right to know, the right of controlling the procedure and the right of recommending corrective actions, of which the supervision power of case filing of supervisory organs consists, get feasible construction.更多还原
