学前教育立法的宗旨及其实现

【摘要】 学前教育立法应以学龄前儿童受教育权的保障为立法宗旨,并以此构建相应的权利义务内容以保障受教育权的全面实现。学龄前儿童受教育权明显区别于义务教育阶段受教育权,具有权利主体的特殊性、义务主体的复合性、内容的复杂性、与其他权利的整体性、权利义务的不对等性等特征,呈现受教育权的特殊形态;以自由权属性为根本,兼具社会权、福利权的特征。受教育权的内容可解构为免受不当教育的权利、受教育自由权、学习权、受教育平等权等。学前教育立法应以受教育权的保障为核心宗旨,在立法中坚守儿童利益最大化原则,体现学前教育规律,合理分配各主体的义务,建立学前教育分类管理制度,并重视弱势补偿。

【Abstract】 Legislation for pre-school education should be aimed at protecting the early child’s right to education,and on top of which constructing the corresponding rights and obligations.The early child’s right to education differs obviously from that of those in the compulsory education stage: it features particularity of subject of rights,variety of the subject of duty,complexity of the right to education,integrity of multiple children rights,and inequality of rights and obligations.Such characteristics shape a special pattern of right to education,a pattern that is based on the fundamental right of freedom and blended with social and welfare rights.The content of education right should include the right to be free from improper education,the liberal right to education,the learning right and the equal right to education.The legislation of preschool education should be essentially guided by guaranteeing the right to education.The legislation should follow the principle of"maximizing the interests of children",embody the law of preschool education,rationally distribute the obligations of each subject,establish a classified management system of preschool education and pay attention to the compensation for the weak.
