【摘要】 "丰鸟数据之争"充分揭示了数据的财产价值。基于此,促进数据的流通与强化数据的保护,已经成为数据立法必须解决的两大问题。大数据时代,数据的法律属性发生了质的变化,其不仅具有形式性和可复制性,更具有相关性和价值延伸性。数据法律属性的变化使得传统立法思路已经无法满足数据发展的现实需求,有碍数据财产价值的充分发挥。因此,应当合理转变数据立法思路,积极拓展数据的利用空间,并在规范层面上确立数据的财产价值。此外,还应当在私权体系内部构建起数据新型财产权,以实现对数据财产利用秩序的有效规制。数据新型财产权主要由数据存储权、数据使用权、数据收益权和数据处分权构成。更多还原

【Abstract】 The "data fighting between SF Express and Cainiao Network" fully reveals the property value of data. Promoting the circulation of data and strengthening data protection have become two major issues that must be solved in data legislation. In the age of big data, the legal attribute of data has changed dramatically. Data can be significant in terms of form, reproducibility, correlation and value extension. The change of the legal attribute of data makes the traditional idea of data legislation inadequate for the demand of data development, which hinders the full development of data property value. Therefore, we should reconsider data legislation, expand the space for the use of data and establish the value of the property of the data at a regulated level. In addition, new data rights should be built within the private rights system so as to effectively regulate the utilization of data and property. New data property rights can be divided into data storage rights, data use rights, data benefit rights and data disposition rights.更多还原
