【摘要】 旨在运用实证研究与规范研究相结合的方法对我国实施"环强险"所面临的困境和出路进行分析。在我国,"环强险"的实施不仅受制于突发性环境污染事件区域分布不平衡和区域环境污染治理投资能力不平衡的现实,而且,在制度上既没有明确的法律依据,也没有健全的环境污染侵权诉讼机制。因此,国家应审慎立法为"环强险"提供法律依据,地方应因地制宜实施差别化保险方案,司法系统应更新观念对环境污染侵权诉讼机制进行重塑。唯有如此,方能保证"环强险"成功实施。更多还原

【Abstract】 The article aims to analyze the dilemma and outlets of China’s implementation of environmental pollution compulsory liability insurance by combining empirical research with normative research. In China,the implementation of compulsory liability insurance for environmental pollution is not only subject to the imbalance of regional distribution of sudden environmental pollution incidents and the imbalance of investment capacity of regional environmental pollution control. Moreover,there is neither a clear legal basis nor a sound environmental pollution infringement litigation mechanism. Therefore,the state should prudently legislate to provide a legal basis for environmental pollution compulsory liability insurance,local governments should implement differentiated insurance programs according to local conditions,and the judicial system should update the concept to reshape the environmental pollution infringement litigation mechanism. Only in this way can we ensure the successful implementation of environmental pollution compulsory liability insurance.更多还原
