【摘要】 环境立法的确定性命题提出不惟是纯粹价值理论的逻辑推演,而是对中国环境法治需求与问题的回应。现阶段环境法律可司法性难题的解决、环境行政恣意的克制与环境善治的达成均高度依赖具有确定性的环境立法。在环境部门法的视野之下,这一命题需进一步在实证法上的技术转换,即将这一命题解构为环境法律概念的精确性、环境法律规则结构的完整性与环境法律规则内容的确定性。三个子命题相互耦合,所面临的立法实践难题与因应之策各有侧重。结合《固废法》规则实例,将上述命题具体化,提出针对性的立法技术路线。更多还原

【Abstract】 The certainty proposition of environmental legislation is not only a logical deduction of pure value theory,but also a response to the needs and problems of China’s environmental rule of law.At present,the problem of the judicability of environmental laws,the restraint of environmental administration and the good environmental governance are highly dependent on environmental legislation with certainty.Under the view of environmental law,this proposition needs further technical transformation, that is, to deconstruct it into the accuracy of the concept of environmental law,the integrity of the structure of environmental law rules and the certainty of the content of environmental law rules.The three sub-propositions are coupled with each other with different emphases on the legislative practice problems and corresponding countermeasures.Taking the example of "solid waste law",this paper concretizes the above proposition and puts forward the specific legislation technical route.更多还原
