海上货物运输法强制性体制论

【摘要】 海上货物运输法强制性体制构成了运输法的特质,其贯穿海上货物运输法立法的始终,一枝独秀。论文对海上货物运输法强制性体制进行系统地综合地考察,包括诸如历史渊源、演进的历程、价值趋向、强制性体制的经济学分析以及中国合同法语境中强制性体制的现代化和本土化等一系列问题。第1章是海上货物运输法强制性体制序说。这一章具有导论的功能,是本文展开研究的基础和前提。第2章的研究是以海上货物运输法强制性体制的渊源的历史解读为核心而展开的。本章主要将研究的核心置于系统论下,讲究对海上货物运输法强制性体制渊源的历史研究,从整体出发、注重综合、立体网络式思维。第3章主要以海上货物运输法的立法历程为线索,研究了海上货物运输法强制性体制的发展过程,以达到全面地认识海上货物运输法强制性体制的目的。第4章在法哲学的研究范式下对海上货物运输法强制性体制得以存在的价值进行系统地分析,着重解答海上货物运输法缘何对维系强制性体制“情有独钟”。论文提出了海上货物运输法强制性体制价值论的“二维价值结构”。第5章是对海上货物运输法强制性体制的深入研究,主要采用法律经济学的研究手段,对海上货物运输法强制性体制的存废展开经济学视域内的考证。第6章研究中国合同法语境下海上货物运输法强制性体制的本土化问题。论文提出海上货物运输法强制性体制的自足性理论,运用实证分析方法在“海商文化”维度下对海上货物运输等强制性体质进行独特视角的论证。作为海上货物运输法强制性体价值论——二维价值结构论的佐证,在法经济学的视野下全面地分析了海上货物运输法强制性体制,提出了“软化的多层次强制性体制”的观点,并对强制性体制之下的交易主体、交易合同类型、义务和责任等范畴进行了重新考察。在考察我国《海商法》第4章的缺憾基础之上,以强制性法律规范的基础理论为根基,提出了强制性规范的软化处理模式,并提出了我国《海商法》第4章对于强制性规范的配置的新方案。

【Abstract】 The mandatory legal regime under the Law of Carriage of Goods by Sea outshines others,runs through the legislation of carriage of goods by sea,constitutes the special characteristics of transport laws.This paper synthetically and systematically explores the mandatory legal regime under the law of Carriage of Goods by Sea, including the historical sources,the evolutionary process,the value tendency,the economic analysis on mandatory legal regime as well as series problems of modernization and localization of mandatory legal regime under the Chinese contract laws.Chapter one is an introduction to the mandatory legal regime of Transport Law on the Carriage of Goods by Sea.The introductory function is served as the basic and premise of the paper research.The historical explanation of mandatory legal regime of Transport Law on the Carriage of Goods by Sea in chapter two is regarded as core which mainly puts the research under the systematology.The author seeks the historical research of sources of mandatory legal regime of Transport Law governing the Carriage of Goods by Sea from a whole,stresses synthetic and with a way of dimensional network research.In order to recognize the legislation process of mandatory legal regime under the law of Carriage of Goods by Sea comprehensively,in the second and the third chapter,the author mainly takes it as a clue and studies its developing process. The study in the fourth chapter,under the legal philosophy model,systematically analysis the compulsive system of Transport Law Governing Carriage of Goods by Sea and emphatically answered the reason of Transport Law of Carriage of Goods particularly focused on the mandatory legal regime of the transport laws.The paper proposed an axiology of mandatroy legal regime of Transport Law on the Carriage of Goods by Sea——"double-dimensional value configuration".Chapter five mainly explores the reservation and abolition of mandatory legal regime under the law of Carriage of Goods by Sea under which law and economics angle.Chapter six concerned about the issues on the modernization and localization of the mandatory legal regime of transport law on the carriage of goods by sea under the Chinese contract laws.The paper with a positive analysis method,from a unique angle,proposed a self-sufficiency theory and proceeded a demonstration on the mandatory legal regime under the law of Carriage of Goods by Sea under the maritime law culture.As the corroboration of mandatory legal regime of Transport Law on the Carriage of Goods by Sea——"double-dimensional value configuration" has comprehensively analyzed to the mandatory legal regime under the law of Carriage of Goods by Sea from legal economy view,put forward a view of "Softened multi-level compulsive system" and renewedly investigated the transaction subjects,the transaction contract types and the categories of responsibility and obligation etc.The paper takes the basic theories of mandatory rules as foundation,based on an investigation of the defects in chapter four in Chinese Maritime Code,proposed a softening process mode of compulsory rules plus gives a new scheme of compulsory rules about the forth chapter of Chinese Maritime Code.
