经济全球化条件下的中国劳动关系与工会改革

【摘要】 面对经济全球化的冲击,中国改革开放以来开始越来越多地参与到世界经济体系当中,成为国际贸易、国际投资、世界生产体系以及国际劳动力市场的重要参与者,因此“全球化”视角就成为中国劳动关系问题研究不容忽视的崭新视角。本文正是以经济全球化作为逻辑分析起点,通过解构经济全球化对全球劳动关系的影响,透视中国劳动关系变化和工会改革的路径选择。文章首先对与劳动关系有关的一些基本概念及概念之间的关系进行了辨析,同时,对劳动关系研究的理论传统进行了梳理,继而提出了解读当前中国劳动关系应当遵循的理论逻辑和研究视角,即充分挖掘马克思主义劳资关系理论的当代意义,借鉴西方劳动关系理论模型,重塑劳动关系的话语解释框架,引领中国的劳动关系现实。以此作为整个研究的理论支撑和分析基础。在介绍经济全球化的内涵和特征,简要分析经济全球化对国家之间、对中国内部经济社会发展影响的基础上,着重考察了经济全球化造成的国际劳资关系相对平衡态势的破坏,以及带来的强资本弱劳工的劳动关系格局。同时指出,经济全球化的发展也正孕育着一种约束资本力量的新机制,为重建劳资双方之间相对平衡提供了新的机遇,劳资关系的全球化时代到来。在具体分析经济全球化对中国劳动关系的影响时,文章从功能分析的视角出发,重点论述了经济全球化对中国劳动关系系统的调整产生的客观后果,这种后果不仅体现在劳动关系的外部环境上,而且体现在劳动关系本身;不仅有积极的一面,而且有消极的一面。目前来说,克服经济全球化的副功能,解决好劳资矛盾和冲突,维护劳动者合法权益是当务之急。要解决好中国的劳动问题,仅仅依靠法律法规的健全和文本意义的赋权是远远不够的,更为迫切的是要发展劳工自己的组织,推进工会改革。文章回顾了中国劳动运动优秀传统,深入分析了我国工会运作的现状和困境,围绕构建工会理论的新体系、增强基层工会独立性、发挥工人组建工会的自主性以及罢工权立法等方面进行了建设性的思考。

【Abstract】 Facing the impact of the economic globalization, China has begun to be more and more heavily involved in the international system since the Reform and Opening up. Now China has been an important participant in international trade, international investment, global producing systems and international labor market, thus the ’global perspective’ has become one of new perspectives in Chinese labor relationship research to be reckoned with. The paper summarizes economic globalization as the starting point of the logic analysis, and tells about the change of Chinese labor relationship and the path finding of the labor union reform in perspective through deconstructing the impact of globalization on global labor relationship.First of all, the paper differentiates and analyzes some basic concepts related to labor relationship and the relationships between the concepts. It also clarifies the theory headstreams of the labor relationship research, thus proposes the theory logic and research perspective that we unscramble the current Chinese labor relationship have to follow, which is the theory support and analysis base, that is to fully excavates the current significance of the Marxist employee-employer relations theory, utilize the theory model of the western labor relationship, reconstruct the discourse explanation frames of the labor relationship, lead the reality of the Chinese labor relationship.When introducing the meaning and characteristics of the economic globalization, the paper puts emphasis on the destroy that economic globalization has made to the comparative balance of international employee-employer relations and the labor relationship structure called strong capital, cheap labor brought based on a brief analysis of the impact of the economic globalization on the countries and the development of Chinese interior economic and society. It also points out that the development of economic globalization now produces a new system that can restrict the capital force and provides new opportunity for the reconstruction of the comparatively balanced employee-employer relations, thus the globalization times come.When analyzing the effect of the economic globalization to China’s labor relationship, the paper mainly discusses the external consequences of the adjustment the economic globalization has made to the labor relationship system from the view of function analysis. The consequences are embodied not only on the exterior background of the labor relationship, but also on the relationship itseif with both the positive and negative effect. The recent urgency to confront the negative function of the economic globalization lies in the solutions to the conflict between labor and capital and the maintenance of rights and interests of the labor.It’s far more than enough to depend on a sound and complete law and regulation and authorization in textual sense in order to solve the Chinese labor issue. The more urgent thing is to develop an organization for the labor themselves. The paper reviews the outstanding tradition of the Chinese labor campaigns, deeply analyzes the current situation and dilemma of the operating of Chinese labor union. The paper also makes constructive thinking about constructing the new system of the labor union theory, strengthening the independence of the basic labor union, fostering the worker’s autonym in establishing labor union and legislation of the strike to right.
