【摘要】 随着科学技术的发展和市场竞争的加剧,通过共享供应链上的知识资源,可以有效提高供应链的整体竞争力。然而,知识共享却使供应链企业不可避免地要面临知识产权风险。因此,研究供应链知识共享环境下的知识产权风险防范问题无论是对提高供应链的整体运作效率,还是对供应链企业谋求进一步发展都具有非常重要的、深远的意义。本文首先分析了加强知识产权风险防范研究的理论意义和实践意义;之后,对国内外现有相关研究文献做全面、系统的综述研究,从而明确本文的研究领域和研究方法。文章在对供应链知识共享的动因从四个方面进行分析的基础上,指出供应链知识共享的合理性与必然性;并且,从演化博弈论的视角定量分析了企业知识共享的策略选择,从而弥补了以往研究中对于知识共享动因多为描述性的解释以及对知识共享策略选择条件未加定量研究的不足;在对演化博弈模型结果的进一步分析中,识别供应链知识共享的影响因素,并有针对性地研究了供应链知识共享的实现途径。供应链知识共享的实现无法避免知识产权风险的发生,因此文章进一步对供应链知识共享环境下的知识产权风险的存在从知识外部性的视角进行了经济学机理研究,并且通过构建完全信息动态博弈模型和完全信息监督博弈模型,指出了知识产权风险的触发条件;在此基础上,构建了知识产权风险的模糊综合评价模型,从而弥补了以往研究中将知识产权侵权视为前提条件而并未加以研究的缺憾。最后,文章针对我国目前知识产权环境中存在的问题提出了政策建议以及构建国家信用治理机制必要性和可行措施;通过建立基于信号博弈的知识共享伙伴选择模型给出了供应链知识共享伙伴选择的对策措施;文章最后建立了一个供应链知识共享收益分配契约设计模型,从而为规避知识产权风险提供可资借鉴的契约设计思路。更多还原

【Abstract】 With the development of science and technology and the market competition becoming fiercer, the knowledge sharing among can significantly improve the competence of the whole supply chain. However, supply chain members have to face the intellectual property risks under the environment of knowledge sharing in supply chain. So, it is meaningful to the improvement of supply chain operation efficiency and to the further development of supply chain members to explore the intellectual property risks in knowledge sharing in supply cahin.First of all, the theoretical and practical significance of strengthening the research of intellectual property risks prevention system was analyzed, and then a comprehensive and systematic review of related domestic and foreign papers was presented. Based on the above analysis, the research areas and methods of this paper were identified.After that, the knowledge sharing drivers among supply chain members were investigated from four aspects, and the rationality and necessities were presented. Then, the knowledge sharing strategies of the supply chain members were quantitatively analyzed by using evolutionary game theory. The research results provided valuable supplements to the previous related studies, which focused on descriptive explanation of the knowledge sharing drivers, and overcame the shortcomings of no quantitative analyses were conducted in previous reaearches. Based on the further analysis of the evolution game model, the influence factors were identified and pertinent methods were provided to realize the knowledge sharing in supply chain.The knowledge sharing in supply chain cannot guarantee the avoidance of intellectual property risks, so the existence mechanism of intellectual property risks under the knowledge sharing in supply chain was further analyzed from the perspective of the externality of the knowledge. Based on the above analysis, the trigger conditions of intellectual property risks were quantitatively explored by establishing complete information dynamic game model and complete information supervising game model. Furthermore, a fuzzy comprehensive evaluation model was established to quantitatively assess the intellectual property risks. The study can make up the previous research pitfalls that no concrete investigation was conducted to explore the trigger conditions of intellectual property risks. In the last part of this paper, policy suggestions were presented according to the current intellectual property environment in China, and the necessities of constructing state integrity governance mechanisms were investigated and feasible measures to the integrity governance were presented. A message game model was used to identify the knowledge sharing partners in supply chain, and some counter measures were also provided. A revenue allocation contract model of knowledge sharing in supply chain was designed, the model can be used as a reference for contract design in practice to avoid intellectual property risks.更多还原
