中国林业社会化变革与发展制度研究

【摘要】 本论文研究综合采用比较分析法、案例分析法、系统的与层次的分析法,分析了我国当前我国林业经济制度的现状及其“部门办林业”的制度历程,揭示了当前我国“部门林业”制度运行中存在的主要问题,分析了当代中国林业社会化变革的客观必然性,进而研究了林业社会化条件下林业经济、资源与环境不同组合方式及其协调发展的内在机理;从中国的国情出发,研究林业社会化发展的策略模式和在该模式下的制度革新,以期为政府制订林业社会化发展的政策与法规提供有价值的依据和支持。论文研究认为:(1)必须将林业用地和农业用地分层次地规划出来,在林业用地内进一步将生态林业用地和商品林业用地分层规划;通过对稀缺的土地资源进行合理的规划、法制化约束、分类化经营,来提高林地的利用率和改善林业生产经营中的土地资源不确定性状况,以此确保林业与农业的协调发展。(2)必须对森林资源的生态效益实施国家定向合同购买或代理(社会)合同购买的办法来校正林业生产的外部性。论文提出了通过建立国家对生态林实施“生态效益(产权)合同购买”、对商品林实行“林分生态等级财政补贴(补助)”制度的激励强刺激,来推动中国林业社会化的快速发展;通过建立“合同管理、法律约束”的制度来加强国家对于林业社会化发展的宏观控制。(3)必须通过制度革新,建立起多元林业主体对林业投(融)资的激励机制、以市场为核心的资源配置机制、以产业为载体的发展动力机制。林业的产业化不仅包括商品林业生产经营的产业化,当前更要创新实现生态林业的产业化。当代中国林业社会化发展,应该确立以“地类规划、资源定位”为基础、以“法律约束”为保障、以“分类经营”为手段、以“生态效用产权购买(或补贴)”为刺激、以“合同管理”为约束、以“多元化投资”为动力、以“产业化经营”为载体、以“市场化运作”为方向、以实现林业的可持续发展为目标的制度体系。在本课题研究中,界定了林业社会化概念的内涵与特征,界定了“社会办林业”与“部门办林业”概念的内涵与制度区别,研究了林业社会化发展的内在规律,分析了当代中国林业社会化变革和发展的制度目标,提出了中国林业社会化发展的总体策略框架,研究了在该策略框架下的相关制度革新目标,从而初步构架出了当代中国林业社会化发展的制度体系。

【Abstract】 In this paper, by adopting the methodology of comparing, case-analyzing, system-analyzing, the author makes a study on the actuality of our country’s forestry economy system and the history of the forestry management by the State-departments. The author analyses the problems of the current forestry economy system and the inevitability of the reforming of the forestry socialization.Then, the author analyzes the inner mechanism of combination and harmonious development between forestry economy, resource and environment. Form the view of the reality of China, the author also studies the suitable policies of forestry socialization and the innovative system in order to afford valuable gist and information for government’s new policies and laws of forestry socialization.The author’s main points in this paper are as follow:(1) Land for agriculture and land for forestry must be compartmentalized, and in the land for forestry, the land for eco-forestry and land for merchandise forestry must be distinguished from each other. In order to improve the utility rate of the forestry land and ameliorate the problem of indetermination of the forestry management, the rare land resources must be programmed reasonably, be restricted by laws, and be managed in different categories. It can ensure the forestry and the agriculture development harmoniously.(2) For the sake of ecological benefit of forestry resources, the external economy of forestry production must be adjusted by adopting state-oriented contract or agent-oriented contract system. In this paper, the author insists that the forestry socialization can be developed rapidly in China if we adopt the stimulating policy of ecological-benefit-contract-purchase on the ecological forestry and adopt the policy of rating-financial-subsidy on the merchandise forestry .We also should strengthen the macro control to forestry socialization development by building up the system of contract-management and law- restriction.(3) The author puts forwards that we should reform our system, build up the stimulating mechanism of multi-investment on the forestry, establish the market-oriented resource configuration system and develop the motivate system based on industry. The industrialization of forestry includes not only commercial forestry industry, but also eco-forestry. The forestry industry development in China needs the system innovation which based on land-rank-layout and resource-location, ensured by law restriction, based on classification management, stimulated by natural benefit purchase, restricted by contract management, powered by multi investment, carried by industrialization management and
