【摘要】 中国共产党在推进改革开放和社会主义现代化的历史进程中,面临着复杂的环境和繁重的任务,机遇和挑战并存。现在,中国共产党在执掌政权、领导国家社会和管党治党等方面所遇到的诸多问题和困惑,都与其对治国理政与自身建设关系科学化认识水平还不够高,尤其是对其实现机制的把握还不够强有关。本文是关于中国共产党治国理政与自身建设关系科学化的实现机制的初步研究。研究这一问题是中国共产党面对新挑战和新考验的深刻回应。本文以马克思主义经典作家党的学说为理论指导,在对中国共产党治国理政与自身建设关系进行全面理论阐释的基础上,着力研究中国共产党治国理政与自身建设关系科学化及其实现机制问题,重点研究如何将中国共产党的领导水平和执政能力通过法制途径上升为国家意志,如何实现中国共产党的领导、依法治国和人民当家作主的有机统一。在研究方法和框架结构方面,论文遵循从一般到特殊的思路,依照逻辑和历史相统一的原则展开。除导论外,论文分为六章。在导论部分主要谈了论文的研究背景与意义、国内外研究现状、内容结构、研究方法和论文创新及不足之处等问题。第一章对中国共产党治国理政与自身建设关系科学化的基本理论进行了阐释,第二部分至第六部分重点探讨了中国共产党治国理政与自身建设关系科学化的法治生成机制、文化建设机制、制度运行机制、能力提升机制和评价机制。第一章对中国共产党治国理政与自身建设关系科学化的基本理论进行了阐释。论文认为中国共产党治国理政与自身建设关系科学化的构成要素包括党内关系科学化、党政关系科学化、党与社会关系科学化及政党关系的科学化。实现党治国理政与自身建设关系科学化,需要通过党的建设推动国家和社会建设,把党的建设优势转化为发展优势,把党的建设资源转化为发展资源,把党的建设成果转化为发展成果,实现党治国理政与自身建设的良性互动。实现党治国理政与自身建设关系科学化,需要全面认识和自觉运用社会主义政党政治规律、中国共产党执政规律和中国共产党自身建设规律,需要坚持以人为本、公平正义和民主法治的价值取向。党治国理政与自身建设关系科学化的实现机制是党实现治国理政与自身建设关系科学化的运行变化的机理和规律,是实现两者关系科学化过程中的各种因素在运动中相互关联、相互制约的作用过程。从结构要素上分析,它包括以下五个部分：法治生成机制、文化建设机制、制度运行机制、能力提升机制和评价机制。上述五大机制作为实现党治国理政与自身建设关系科学化的机制中的五种力量相互作用、相互影响,推动着党治国理政与自身建设关系科学化的实现进程。第二章对中国共产党治国理政与自身建设关系科学化的法治生成机制进行了深入探讨。论文认为中国共产党治国理政与自身建设关系科学化的逻辑起点在于党的领导权始终处于法律的有效监控之下,其基本途径是通过完备的法律制度体系和有效的法治运作机制使党的内部治理和外部活动都体现法治原则,使党在公民社会与公共权力中始终保持畅通的桥梁纽带作用,从而有效地增强党与国家、社会的内在契合性,提升中国共产党的执政能力和自身建设水平。党治国理政与自身建设关系科学化的法治生成机理是借鉴内生型法治和外生型法治生成模式的优点,实现自然演化与理性建构相结合的共生；发展逻辑是从制度构建转向提高法治能力,实现由浅层法治向深层法治的转变。建立健全党治国理政与自身建设关系科学化的法治生成机制的基本原则是依据国家宪法和政党章程处理好党治国理政与自身建设的关系,具体途径是培养有利于实现党治国理政与自身建设关系科学化的法律文化、推进党内法规制度和国家法律制度的创新、推进党的领导行为和政党权力运行的法治化、培养党员的法权人格、加强法治文化资源的整合以及实现党自身的现代化。第三章对中国共产党治国理政与自身建设关系科学化的文化建设机制进行了深入探讨。论文认为政党文化的构成要素分为标示要素和评价要素两部分。标示要素包括政党意识、政党心理、政党伦理、制度规范和行为方式,评价要素指的是政党形象。中国共产党的政党文化是政党意识、政党心理、政党伦理、制度规范、行为方式和政党形象的统一有机体,它们之间是一个相互联系、相互依托、相互制约的关系。中国共产党实现治国理政与自身建设关系科学化的进程,从文化的角度来考量,实际上就是建设政党文化的过程。构建党治国理政与自身建设关系科学化的文化建设机制需要发挥党员在建设政党文化过程中的主体作用,发挥各级党组织在建设政党文化过程中的领导作用；需要加强政党文化的物质载体建设、制度载体建设、心理载体建设、行为载体建设和活动载体建设；需要运用生态协调规律,推动政党文化内部系统均衡发展；需要遵循生态交互法则,优化政党文化的经济、政治和文化生态环境。第四章对中国共产党治国理政与自身建设关系科学化的制度运行机制进行了深入探讨。论文认为中国共产党的历史就是制度权威在党的治国理政事业和自身建设工程中逐步确立并强化的过程。党治国理政和自身建设关系科学化的制度建设是一个在实践中不断探索、持续创新的过程。党治国理政与自身建设关系科学化的制度的作用空间主要由经济空间、政治空间、文化空间、社会空间和法治空间组成。党治国理政和自身建设关系科学化的制度体系建设包括党内关系科学化的制度体系建设、党政关系科学化的制度体系建设、党社关系科学化的制度体系建设和政党关系科学化的制度体系建设。构建这一机制必须遵循科学的原则即合法性原则和有效性原则,需要提高党治国理政和自身建设关系科学化的制度制定和执行力水平,需要实现党治国理政和自身建设关系科学化的制度制定和执行的程序科学化、强化制度执行的保障机制并加强制度执行的监督机制。第五章对中国共产党治国理政与自身建设关系科学化的能力提升机制进行了深入探讨。论文认为中国共产党治国理政与自身建设关系科学化的实现过程,就是党在建立健全治国理政与自身建设关系科学化的法治生成机制、文化建设机制、制度运行机制的基础上,为了科学处理两者关系不断提升综合能力的过程。要保证党实现治国理政与自身建设关系的良性互动,就必须将政党组织与国家政权组织、社会组织与其他政党组织有机结合起来,形成整体的意志与力量。中国共产党是把这几部分有机整合起来的主体,在整合过程中所形成的整体的意志与力量就体现为中国共产党的综合能力。从发生学的角度来说,中国共产党的综合能力是在党推动自身发展、国家发展、社会发展和其他政党发展中形成的,是中国共产党自身的能力、国家政权组织的能力、社会的能力和其他政党能力多方互动的产物。建立健全党治国理政与自身建设关系科学化的能力提升机制需要加强管党治党能力建设、执掌政权能力建设、多党合作能力建设、领导社会能力建设和政党外交能力建设。第六章对中国共产党治国理政与自身建设关系科学化的评价机制进行了深入探讨。论文认为党治国理政与自身建设关系科学化的评价机制是由评价主体、评价指标、评价方法、评价体系技术整合、评价结果运用等一系列要素所构成的。建立党治国理政与自身建设关系科学化的评价机制,有利于党在实现治国理政与自身建设关系科学化的进程中进行合理的资源配置,对于实现好、维护好、发展好最广大人民的根本利益具有重要的意义。能否推动社会的发展与历史的进步,提升人民的幸福指数,是党治国理政与自身建设关系科学化评价的最根本的标准。构建党治国理政与自身建设关系科学化的评价机制从动态连续的过程角度而言包括评价准备阶段、组织实施阶段以及评价结果的管理阶段等一系列环节,建立健全这一机制需要加强党治国理政与自身建设关系科学化的评价机制的主体设计、指标设计、方法设计,实现评价体系的技术整合,并对评价结果进行动态的管理。更多还原

【Abstract】 The Communist Party of China is faced with unprecedented opportunities for development as well as risks and challenges in promoting reform and opening up and socialist modernization. At present the CPC faces new problems and new puzzles in strengthening the Party’s governance capacity and its self-building for lack of understanding and grasping the essence of the realization mechanism of the scientific relationship between Party governance and Party building. This article is the preliminary research on the realization mechanism of the the scientific relationship between Party governance and Party building. It is the profound response of the new challenges and new tests.Using Marxist standpoint, viewpoint and methods, the author attempts to summarize the realization mechanism of the scientific relationship between Party governance and Party building theoretically and offer some possible solutions. The article emphasizes on making good use of legal procedures to turn the Party’s propositions into the will of the state so as to integrate the leadership of the Party, the position of the people as masters of the country, and the rule of law. In the aspects of research method and frame structure, the paper starts with idea from ordinary to special and follows the principle of unity of logic and history.Besides the introduction, there are six chapters in the paper. It mainly talks about the issues of the research background and significance, domestic and foreign scholar’s theoretical research on the CPC governance and Party building, content structures, research methods, innovative points and deficiencies in the introduction. The first chapter illustrates the basic theories of the scientific relationship between Party governance and Party building of the Communist Party of China. From the second part to the sixth part, it emphasizes on the discussion of the realization mechanism for the scientific relationship between Party governance and Party building including legal generative mechanism, culture construction mechanism, system operation mechanism, capability improvement mechanism and evaluation mechanism.In the first chapter, the author illustrates the basic theories of the scientific relationship between Party governance and Party building of the Communist Party of China. In the paper, it is believed that the elements for the scientific Party governance and Party building relationship are involved with how to deal with the inner Party relations, Party and state relations, Party and social relations and inter-Party relations scientifically and realize the benign interaction and scientific development for Party governance and Party building. To realize the scientific relationship between Party governance and Party building, we need to promote the national and social construction, to transform the advantage of Party building into development advantage, to transform the resource of Party building into development resource and transform the achievements of Party building into the development achievements through Party building and then realize the positive interaction between Party governance and Party building.To realize the scientific relations between Party governance and Party building, one needs to have a comprehensive understanding and consciously applying the political rules of socialist Party, the governance rules of the Communist Party of China and the rules of the Party building of the Communist Party of China.We need to insist on the human-centered, righteous and democratic value orientation under the rule of law. The realization mechanism of the scientific relationship between Party governance and Party building is the mechanism and rule for the Party to realize the operation of the scientific relationship between Party governance and Party building.In the process all kinds of factors connect with each and restrict each other. From the perspective of structural elements, it includes legal generative mechanism, culture construction mechanism, system operation mechanism, capability improvement mechanism and evaluation mechanism. As five powers for the realization of the scientific relationship of Party governance and Party building, the above mechanisms mutual interacts and mutual influences each other and promotes the realization progress of the scientific relationship between Party governance and Party building.In the second chapter, the author makes an in-depth discussion on the legal generative mechanism of the scientific relationship between Party governance and Party building.In the paper, it is believed that the Party must act within the scope prescribed by the Constitution and laws, which is the logical starting point of the scientific relationship between Party governance and Party building.The basic method is to use the complete legal system and the legal operating mechanism to ensure the Party’s internal governance and external activity embody the rule of law and the Party keeps a role of "bridge" between the civil society and public power.By this way,we can enhance the internal compatibility among the Party, the state and the society so as to improve the Party’s art of governance and increase its self building ability.It is also believed that the mechanism of the scientific relations between Party governance and Party building has learned the advantages of the endogenous mode and external mode legal governance to realize the symbiosis which combines the natural evolution and rational construction; Development logic is the transformation from system construction to the improvement of legal governance capability to realize the deep legal governance from superficial legal governance. The basic principle for establishing and improving the scientific relationship between Party governance and Party building is handling the relationship of Party governance and Party building according to the Constitution and Party Constitution, the basic method is to cultivate the legal culture which is beneficial to the realization of the scientific relationship between Party governance and Party building, promote the innovation of the inner Party regulations and national legal system, promote the legalization of the Party’s leadership and the implementation of political power, cultivate the legal personality of Party members and enhance the integration of the legal cultural resource and realize the modernization of the Party.In the third chapter, the author makes an in-depth discussion on the cultural construction mechanism of the scientific relationship between Party governance and Party building of the Communist Party of China. In the paper, it is believed that the Party culture is consisted by two parts as symbol element and evaluation element. Symbol element includes Party consciousness, Party psychology, Party ethic, system criterion and Party action while evaluation element refers to the image of the Party. The Party culture of the Communist Party of China is a unified organism of Party consciousness, Party psychology, Party ethic, system criterion, Party action and Party image. Those elements are interacted, rely on each other and restrict each other. From the perspective of culture, the process for the Communist Party of China to realize the scientific relationship between Party governance and Party building is a process for the construction of the Party culture. To construct the cultural construction mechanism for Party governance and its self building requires us making full use of the principal role of Party members and organizations in the construction of Party culture. It requires us enhancing the material carrier construction, the system carrier construction, the psychological carrier construction, behavior carrier construction and activity carrier construction and using the eco-coordination rule to promote the balanced development in the internal system of Party culture. It also requires us to follow the ecological interaction rules, optimize the economical, political and cultural ecological environment of the Party culture.In the fourth chapter, the author makes an in-depth discussion on the operation mechanism of the scientific relationship between Party governance and Party building of the Communist Party of China. In the paper, it is believed that the history of the Communist Party of China is the process of the establishment of system authority in Party governance and Party building process. The system construction of the scientific relationship between Party governance and Party building is a course to explore and innovate in practice. The function of the system of the scientific relationship between Party governance and Party building is consisted of economical space, political space, cultural space, social space and legal space. The structural system construction of the scientific relationship between Party governance and Party building includes the structural system construction of scientific inner-Party and inter-Party relationship, the structural system construction of scientific relationship between the Party and the state and the structural system construction of scientific relationship between the Party and social organizations.To construct this kind of mechanism, we need to follow the scientific principle that is the principle of legality and validity. We need to improve the level of the system making and implementing for the scientific relationship between Party governance and Party building and the specific method is to realize the scientific implementation process, enhance the safeguard mechanism and supervision mechanism of the implementation of the system.In the fifth chapter, the author makes an in-depth discussion on the mechanism of capability improvement for the scientific relationship between Party governance and Party building. In the paper, it is believed that the realization process for the scientific relationship between Party governance and Party building is a course for the Party to establish and improve the legal generative mechanism, culture construction mechanism, system operation mechanism as to improve its comprehensive ability. To ensure the positive interaction of the relations between Party governance and Party building, we must integrate the relations between the Party organizations, organization of state power, social organizations and other Party organizations organically to form the overall will and strength. The subject that integrated organically by the Communist Party of China, the will and strength formed in the integration is embodied by the comprehensive capability of Communist Party of China. The comprehensive abilities of the Communist Party of China are formed in the process of promoting the Party’s development, state development, social development and other Party’s development and they are the production of the interaction of the Party’s ability, the organizational ability of state power, the social ability and other Party’s ability. To construct and improve the ability improvement mechanism for the scientific relationship between Party governance and Party building requires us to enhance the ability in managing and governing the Party, the ability to govern the country, the ability for multi-Party cooperation, the ability in leading the society and the Party’s diplomatic abilityIn the sixth chapter, the author makes an in-depth discussion on the evaluation mechanism of the scientific relationship between Party governance and Party building. In the paper, it is believed that the evaluation mechanism of the scientific relationship between Party governance and Party building is consisted of a series of elements such as the evaluation subject, the evaluation indicators, the evaluation approaches, technical integration of the evaluation system and the using of the evaluation result. To construct the evaluation mechanism for the scientific relationship between Party governance and Party building is beneficial for the Party to allocate the resources reasonably in the process and it is of far-reaching significance for realizing, safeguarding and developing the fundamental interests of the overwhelming majority of the people. The most fundamental standard for the evaluation of the scientific relationship between Party governance and Party building is whether it can promote the social development and historical advancement and improve the happiness index of the people or not. From the aspect of the dynamic and continuous process, the construction of the evaluation mechanism for the scientific relationship between Party governance and Party building includes a series of stages, such as the preparation stage, organization and implementation stage and the management stage of the evaluation results. To establish and improve this mechanism, we need to strengthen the subject design, index design, method design in the scientific relationship between Party governance and Party building, realize the technical integration of the evaluation system and have a dynamic management of the evaluation results.更多还原
