我国公共文化服务政策研究

【摘要】 本文立足于当前我国公共文化服务的实践,运用法学、管理学、公共经济学、公共政策学等理论,解读公共文化服务的必要性,在此基础上,探讨我国公共文化服务相关政策的框架和路径。文章首先分析公共文化服务的现实依据和理论基础,通过回溯权利及人权概念的源起,探讨文化权利的内涵,探讨政府保护文化权利的具体职能和措施,解析公共文化服务与政府职能转变的逻辑关系,阐明公共文化服务既是保障公民基本文化权益的有效途径,也是建设服务型政府的必然要求。在此基础上,对公共文化服务的内涵、特点、主体和供给方式进行研究和分析,指出公共文化服务有广狭之分,狭义的包括文化遗产保护、文化设施及服务、文化培训、文化资助、针对弱势群体的保障性服务等内容,广义的不仅包括公共文化服务,也包括文化行政和制度。公共文化服务的特点有公共性、公益性、公平性、基础性、意识形态性、便利性等。根据公共产品理论和我国国情,分析不同主体在公共文化服务中的作用,提出政府在公共文化服务中起主导作用,应承担组织者、出资者和管理者的角色;公益性文化机构为骨干力量,是公共文化服务的直接提供者;企业为公共文化服务的有益补充;社区、公民则为参与主体。我国的公共文化服务应坚持政府主导、充分调动社会力量积极参与、发挥市场积极作用的综合供给模式。为了使公共文化服务政策更加具有针对性,文章详细回顾我国公共文化服务所开展的工作、取得的重大进展,指出通过多年努力,公共文化设施网络不断健全,重大文化惠民工程顺利实施,社会文化活动更加丰富多彩,同时也存在着投入低、公共资源供给城乡及区域结构失衡、服务水平不高、社会力量参与不够等问题。借鉴其他国家的有益经验,并结合当前我国公共文化服务现状,文章分析了我国公共文化服务政策体系的基本框架及原则,指出可按照效力层次、作用、内容等标准对我国公共文化服务相关政策进行不同分类,按照内容应该包括公共财政支持政策、公共文化设施建设运行政策、社会力量参与鼓励政策、资源配置政策、需求反馈机制、政策绩效评估机制等内容,应该遵循公平正义、民主公开、效益最大化、可操作性等原则,按照经费保障政策、公共文化产品供给政策、绩效分析的主题分析我国已有相关政策,找出不足,提出完善这些政策的意见和建议。

【Abstract】 This thesis, on the basis of the current public culture service practice in China, probes into the overall framework and detailed approach of related policies on Chinese public culture service by analyzing the necessity of public culture service with theories of legal science, public policy, management and public economy.Firstly, it analyzes the theoretical and practical basis of public culture service, explores the meaning of cultural rights by tracing the deveopment of rights and human rights, and clarifies the government measures to be taken for the protection of cultural rights. Besides, it examinesthe logical relationship between government function transformation and public culture services with public goods theory, and concludes that public culture service is an effective means to protect the basic cultural rights and interests of citizens and to build service-oriented government. On this basis, it studies the connotation, characteristics, subject matter and supply form of public culture service.This thesis looks at public culture services from both broad and narrow sense. In the narrow sense, public culture service includes the protection of cultural heritage, museums and other cultural facilities and services, radio and television facilities and services, cultural financing, training, security service of vulnerable groups, etc. Public cultural services are featuring public nature, public welfare, equity, fundamentality, ideology and convenience. According to basic theory on the provision of public goods, in view of China’s national conditions, the thesis advances that defferent subbject matter paly deffrent role, the Government should assume a leading role in the public culture service as the organizer, financier and regulator, while nonprofit cultural institutions should act as the backbone and direct providers of public cultural services. Meanwhile, enterprises should act as the complement of public culture services with competitive advantages, while community and citizens, the main participators. Public culture services in China should adhere to integrated supply mode of Government guidance, full mobilization of social forces to participate, exertion of positive role of the market.Subsequently, it reviews the work carried out by our country’s public culture service in detail, in which substantial progress has been made in constantly improved public culture facilities network, smooth implementation of projects in the interest of the public, and rich major social and cupublic, and rich major social and cultural activities. Meanwhile, there are still problems in this regard such as low supply of inputs, imbalanced supply of public resources among urban and rural areas, insufficient service level, low-participation rate of social forces. In view of the current status of public culture service, with reference to the useful experience of other countries, the thesis analyzes the overall framework and the principles of China’s public culture service policy, and put forwards its different classification methods according to effectiveness levels, role, content and other criterions. Classified by contents, it should include public financial support policy, operational policy of public culture facilities construction, mobilization of social force participation, and favorable policy of resources distribution equity, needs feedback mechanism and policy performance assessment, etc. Besides, the principles of fair and justice, maximized efficiency, operability, democracy and transparency should be followed. Finally, the details of the various policies are analyzed and corresponding suggestions are put forward。
