【摘要】 财产权的正当性总是和法律范式的转换有着密切的相关性，并且法律范式的转换往往通过财产权的变化体现出来。财产权的特殊性就在于个体既要和身外之物发生联系，又要顾及到其他个体及社会的存续。在多元主义背景下，如何把握个体与外在物和个体之间及个体与社会间的关系就成为财产权正当性的主题。一方面，在与外在物的关系中，需要发挥个体的特性使其尽可能多的创造物质财富；另一方面，又需要通过社会机制以保证每一个社会成员都能有体面且全面的社会生活。所以，尽管不同的财产权承担不同的社会任务，但是通过综合性判断的模式给不同类型的财产权提供统一的正当性基础却是可能的，也是必要的。通过对个体要素、社会要素及效率、功利、公平、正义等价值的解析，可以为我们认识和把握两者之间的辩证关系提供一个更加合理的视角，可以更好反思和批判财产权及其制度。更多还原

【Abstract】 The legitimacy of property rights always has relation to the conversion of legalparadigm, and this conversion often manifests itself through changes in property rights.The particularity of property rights is that not only individual should connect withexternal objects, but also takes the existence and development of other individuals andsociety as a whole into account. According to pluralism, grasping the relationshipsbetween the individual and external objects, individuals, and individual and society isthe subject of legitimacy of property rights. On the one hand, the point of relationshipbetween the individual and external objects is that we need to create material wealth asmuch as possible through individual characteristics; on the other hand, we needconstruct social mechanism to ensure every member of society with a decent andcomprehensive social life. So, although the different property rights assume differentsocial missions, it is possible, and also necessary, that the comprehensive judgmentmodel provides a unified legitimate fundation for different types of property rights.The analyses of individual factor, social factor and efficiency, utility, fairness, justicein property rights provide a more reasonable perspective for understanding andgrasping the dialectical relationships between the two hands, and we can reflect andcriticize the property rights and its institutions well based on these analyses.更多还原
