【摘要】 近年来,城镇化与农民工问题已经成为各级政府部门和学界持续关注的社会热点话题,农民工基本权益保障问题也为我国学界的一个重要研究课题。农民工作为我国新型产业工人的重要组成部分,是城镇现代化建设事业的重要力量,也是社会主义新农村建设的先行者。在我国社会转型时期,农民工群体作为社会主义现代化、工业化和城镇化建设的新型劳动大军,为促进我国城乡经济社会发展做出巨大贡献。然而,由于我国经济社会结构转型、自由市场制度和传统户籍制度等综合因素的影响,农民工逐渐成为城镇社会规模庞大的弱势群体,游离于城镇与乡村社会的边缘。在现实生活中,一些政府部门和社会各界对农民工基本权益保障工作和认识不足,致使进城农民工的基本权益屡屡遭受侵害。长期以来,农民工的身份认同和基本权益保障等问题常常被政府部门和社会各界所忽视,农民工难以共享城镇社会的公共服务和福利待遇。由于历史原因、制度原因、法律原因、观念原因和农民工自身的内在原因,导致农民工的政治、经济、文化、社会等基本权益保障严重缺失。党中央和国务院高度关注农民工问题,先后出台了《国务院关于解决农民工问题的若干意见》等法律法规,全国各地在保障农民工基本权益和改善农民工工资待遇等方面采取了很多切实有效的政策与措施,但是我国农民工基本权益保障的立法保护、执法监督、司法保障以及法律援助等方面尚存诸多不足之处,农民工基本权益保障的整体状况仍不容乐观。如何维护和保障农民工的基本权益,是解决农民工问题的重中之重。解决农民工基本权益保障问题,事关农民工能否顺利融入城市和实现市民化,事关我国工业化和城镇化建设的发展进程,事关我国经济健康发展与和谐社会建设。研究和解决农民工基本权益保障问题,有利于尊重和保障人权,有利于解决“三农”问题,有利于维护社会稳定和构建和谐社会。本文的『F文部分主要分为五部分。第一章,通过对农民工基本权益保障的理论分析,全面分析农民工的概念与基本特点、农民工基本权益的概念、农民工基本权益保障的概念、特点及内容等基本内涵,从人权理论、社会公平理论、法治理论和责任政府理论等方面,探讨农民工基本权益保障的理论基础与渊源。第二章,通过分析农民工政治权益和政治组织保障缺失等问题,农民工不平等的就业权益等经济权益保障缺失问题；农民工文化教育培训权益的保障问题；农民工的社会保险、社会福利和社会救助等社会权益的保障问题,客观分析加强农民工基本权益保障研究的重要性和紧迫性。第三章,通过分析户籍、法律、就业、教育培训和社会保障等制度瓶颈,探析我国农民工基本权益保障的立法工作、司法保护、法律执行能力与法律援助等法律制度原因,客观分析城镇政府部门及其决策者、社会歧视和农民工等主体的歧视观念,全面分析农民工文化素质、思想观念、组织化程度和城市适应能力等内在原因。第四章,通过建立健全农民工基本权益保障的相关机制,构建政府部门、用工企业、城镇社区、传播媒介、非营利组织和农民工等诸多主体参与的维护农民工基本权益的保障机制,建立健全农民工基本权益保障的表达、执法监督、司法保护和法律援助机制。通过确立农民工基本权益保障制度的改革原则,不断完善户籍制度、就业制度、教育培训制度、社会保障制度等相关制度。第五章,通过逐步完善农民工基本权益保障的法律体系,不断完善农民工基本权益保障的立法原则以及相关法律法规,制定专门的《农民工权益保护法》,建立健全其司法保护体系、执法建设、法律援助制度、体系与机制,加强农民工基本权益保障的法制普及、宣传与教育,强化农民工的法律意识、维权意识和维权组织建设。本文在吸收和借鉴他人研究成果的基础上,力求有所创新之处,以全面、科学分析农民工基本权益保障的现实问题、深层原因以及保障机制、制度与法律体系。希望在论文框架和研究方法上有所创新,综合运用政治学、人类学、社会学、法学、文化学等诸多学科知识,以从多角度、全面和科学探析农民工基本权益保障问题。由于本文跨学科内容较多、全面研究该论题的文献不多和作者知识储备与理论水平有限,关于该论题的很多理论与实践问题有待于进一步深入研究,有些理论阐述与实证分析还存在不妥之处。更多还原

【Abstract】 In recent years, urbanization and the issue of migrant workers has become a hot topic at all levels of government departments and academia sustained attention to the social, the basic guarantee of the rights of migrant workers is also an important research topic of China’s academic. Farmers work as an important part of China’s new industrial workers is an important force in the urban modernization, is also a pioneer in the construction of a new socialist countryside. Groups of migrant workers in the Period of Social Transformation, as the socialist modernization, industrialization and urbanization, the construction of a new labor force, make a significant contribution to the promotion of urban and rural economic and social development.However, due to economic and social restructuring, the factors of the free market system and the traditional household registration system, migrant workers becoming vulnerable groups of the urban social scale, drifted away from the edge of the urban and rural society. In real life, the protection of the basic rights and interests of migrant workers and lack of knowledge of some government departments and the community, the resulting migrant workers basic rights have repeatedly been violated. A long time, the identity of the migrant workers and the basic rights and interests of security issues often ignored by the government and the community, and migrant workers is difficult to share public services and urban social welfare benefits.Due to historical reasons, institutional reasons, legal reasons, the concept of cause and migrant workers own internal reasons, resulting in a serious lack of political, economic, cultural, social and other basic rights protection of migrant workers. CPC Central Committee and the State Council attach great attention to the issue of migrant workers, has issued a "State Council on the number of opinions" to solve the problem of migrant workers and other laws and regulations across the country to protect the basic rights and interests of migrant workers and improve the wages of migrant workers to take a lot of effective policies and measures, but security legislation to protect the basic rights and interests of migrant workers in China, the supervision of law enforcement, judicial guarantees and legal assistance, there are still many shortcomings, the basic rights and interests of migrant workers overall security situation is still not optimistic.How to maintain and protect the basic rights and interests of migrant workers, is the most important to solve the issue of migrant workers. Solve the fundamental guarantee of the rights of migrant workers, migrant workers related to the successful integration into the city and become urban residents, is related to the development of China’s industrialization and urbanization process is related to the healthy economic development and building a harmonious society. Study and solve the fundamental guarantee of the rights of migrant workers, is conducive to respect for and protection of human rights, help solve the "three rural" issue, and is conducive to maintaining social stability and building a harmonious society. The body part of this paper is divided into five parts.The first chapter, by the theory of basic rights and interests of migrant workers protection analysis, a comprehensive analysis of the concepts and basic characteristics of migrant workers, the basic connotation of the concept of the basic rights and interests of migrant workers, migrant workers basic rights protection concept, features and content, from a human rights theory, the theory of social justice, the rule of law theory and the theory of responsible government, and explore the theoretical basis of the protection of the basic rights and interests of migrant workers and origins.Chapter II, issues such as lack of protection by analyzing the political rights of migrant workers and political organizations, economic interest in the lack of protection of migrant workers unequal employment rights; protection of the interests of migrant workers in cultural education and training issues; migrant workers’ social insurance, social welfare and social assistance and other social protection of the interests of migrant workers, an objective analysis of the importance and urgency to strengthen the protection of basic rights of migrant workers research.Chapter III, by analysis of household registration, legal, land, employment, education and training, and the social security system bottlenecks Analysis of China’s migrant workers basic rights protection legislation, the system of judicial protection, law enforcement ability and legal aid and other legal reasons, an objective analysis of town government departments and their policy makers, social discrimination and migrant workers, such as the main concept of discrimination, a comprehensive analysis of the underlying causes of migrant workers and cultural qualities, ideas, concepts, the degree of organization and urban adaptability.The fourth chapter, through the establishment of a sound basic rights and interests of migrant workers protection mechanisms involved in the maintenance mechanism for the protection of the basic rights and interests of migrant workers to build the main body of the government departments, employment enterprises, urban communities, the media, non-profit organizations and migrant workers, and many other established expression and improve the protection of the basic rights and interests of migrant workers, the supervision of law enforcement, judicial protection and legal assistance mechanisms. Established principles of reform of the security systern of migrant workers basic rights, and constantly improve the household registration system, employment system, the education and training system, social security system and other related systems.Chapter V, through the gradual improvement of the legal system of protection of the basic rights and interests of migrant workers, and constantly improve the legislative principles of the protection of the basic rights and interests of migrant workers as well as relevant laws and regulations, the development of special "Migrant Workers’Rights Protection Act, establish and improve the system of judicial protection, law enforcement popularity building, legal aid system, system and mechanism to strengthen the legal protection of basic rights and interests of migrant workers, publicity and education, strengthen the legal awareness of the migrant workers, rights awareness and advocacy group building.In this paper, absorb and learn from others’research results on the basis of, and strive to have innovation. More content of this article interdisciplinary, comprehensive study of the topic literature not much and limited reserves and theoretical level of knowledge about the topic of many theoretical and practical issues should be researched further, some theoretical explanations and empirical analysis there wrong place.This paper uses the method of political science, economics, sociology and law multidisciplinary theory, analysis and synthesis method, inductive and deductive methods, standardized analysis and comparison of research-based, the combined use of historical analysis, literature research mathematical statistics methods, and strive to science, and overall feasibility study of the topic.更多还原
