基于可持续发展的矿地协同利用与管理

Cooperation Utilization and Management of Mining-Land Resources Based on Sustainable Development

【摘要】 在耕地红线逐渐逼近的形势下,耕地保护政策深入执行,一方面矿业开发中的建设用地增量成为矿业准入的重要瓶颈,增加了矿业公司的准入成本;另一方面随着土地复垦管理制度的强化,土地保护与治理费用将加大矿业公司的运营成本。研究矿产资源与土地资源的协同利用与协同管理是解决矿地矛盾,打破矿业开发的土地瓶颈,激活矿业存量用地潜力的重要前提和关键。首先,对矿产与土地资源、资产、资本属性及相互关系进行分析,在其关系辨识的基础上构建了矿地系统。矿地系统是建立在矿业活动与其土地利用系统基础上的集成系统,是在一定土地利用、矿业活动立体空问范围内,含资源、资产、资本管理下的自然技术经济系统与产权关系基础上的社会系统的复合系统。矿地系统理论的构建为矿产资源与土地资源协同利用与管理研究奠定了理论基础。其次,分别对矿业权准入以及运行过程中的矿业权监管以及土地利用监管现状进行分析,结果表明矿业管理与土地管理在矿业权准入阶段的最佳抓手为“采矿权许可”,但作为协同管理的机制必须为规划引导、市场配置,多部门联动监管。矿业权监管现状从技术、制度角度均与土地利用尤其是土地复垦监管存在一定的错位,但随着地下采矿三维动态监管技术的发展以及矿业权、土地复垦监管制度的健全,矿业监管与土地利用尤其是土地复垦将实现一体化管理。再次,分别从矿业城市、矿区、矿山企业三个尺度探讨了矿产资源与土地资源协同利用与管理机制。矿业城市土地资源一方面表现为以矿业用地为主的存量用地闲置、废弃或低效利用,另一方面表现为新增建设用地成为矿业准入以及矿城转型中城乡统筹的主要瓶颈之一。矛盾的解决关键在于促进对矿业存量用地资源流动、产权流转、资本激活,实现为矿业准入腾指标,为矿城发展拓空间,为土地复垦找资金的三赢。从矿区尺度,规划协调性分析是实现矿产资源与土地资源有效配置的利益均衡过程,从不协调向协调转变的路径不是矿业的一味退让,而是建立在相容性与互动性基础上的科学路径选择。从矿山企业尺度,在矿山企业土地成本以及露天矿山企业土地经济效益分析的基础上,探讨了矿山企业尤其是露天矿山企业土地资本在矿业用地改革的形式下,注重存量排土场与增量排土场的有机结合,及时盘活存量,适度发展增量。

【Abstract】 In the situation of farmland quantity approaching to warning line, policy of farmland conservation is executed deeply. On the one hand, construction land increment in mining has become significant bottleneck of permission and make the access cost of mining companies increased On the other hand, with the land reclamation management system intensively, land protection and management fees will make the operating costs of the mining companies increased.It is the key to solve the contradiction between mine and land, break the bottleneck of mining development and activate the potential of mining land stocks to study on collaborative utilization and management of mineral resources and land resources.Firstly, the relationship of resource, assert and capital of mineral resources and land resources were analyzed. Mineral-land system was constructed on the basis of relationship identifying. Mineral-land system is a integrated system based on mining activities and land-use system, also a complex systems within the three-dimensional space scope of certain land use and mining activities, including technical economic system under resource and asset management, and social system based on property relations. Structure of mineral-land system theory lays theoretical foundation for collaborative utilization and management of mineral resources and land resources.Secondly, regulation of mining right and land use in the process of mining right permission and operation were analyzed. It is demonstrated that "mining permission" is the best way for mining management and land management on the stage of mining permission, however, as a collaborative management mechanism, it must be planning guide, market allocation, multi-sect oral linkage supervision. There is a mismatch between regulatory of mining and land from the perspective of technology and regulation, but with the development of3d dynamic regulation technology underground and the soundness of mining right supervision system, mining regulation and land use regulation, especially the land reclamation will implement the integration management.Thirdly, the coordination utilization and management mechanism of mineral resources and land resources were discussed respectively from the perspective of mining city, mining area, mining enterprises. Land resources especially mining land of mining city, on the one hand, manifests idle, abandoned, or inefficient used; on the other hand, construction land become one of the bottlenecks of mining permission and integration development of urban and rural areas. The solution of contradiction is to promote for mining stock flow activation, transfer of property right and capital activation, realizing the triple-win of saving mining access indicators, expanding the space for the development of mining city and finding money for land reclamation. From the viewpoint of mining area, planning coordination analysis is to achieve the interest equalization process of efficient allocation of mineral resources and land resources. The path of the transformation from inharmonious to harmonious is not blindly concession, but scientific path selection based on compatibility and interactivity. Under the form of mining land reform, the open pit mining enterprises must pay attention to the organic combination of stock and increment of dump, at the same time revitalize stock and moderately develop increment in the land use process.
