我国知识产权教育与文化战略研究

【摘要】 知识产权是法律赋予人类对智力劳动成果的人身权利和财产权利。当前,发达国家以知识经济为主导,在注重智力成果转化为商业价值和物质财富的同时,高度重视知识产权教育与知识产权文化的培育,把培养知识产权人才、普及知识产权知识、提升知识产权能力,作为本国知识产权战略的重点内容之一为了适应形势的发展,2005年我国开始制定知识产权战略,2008年国务院颁布我国《知识产权战略纲要》(以下简称纲要),纲要指出:在高等学校开设知识产权课程,将知识产权教育纳入高校学生素质教育体系,并把培育知识产权文化作为我国知识产权战略的重点任务,将全社会知识产权意识的提高、知识产权文化氛围初步形成作为近期的战略目标。由于知识产权制度和文化在近代清末才移植我国,与我国以伦理纲常为核心的传统文化以及长期的为政以德和人治传统有很大的差异,导致知识产权在我国存在制度上的缺失和文化上的缺位,在一定程度上对我国知识产权教育和知识产权文化带来一定的影响,面临诸多的冲击与挑战。主要表现是全社会的知识产权意识还比较薄弱,无论市场主体还是管理主体创造、运用、保护和管理知识产权的能力还不强,尊重知识、崇尚创新、诚信守法的知识产权文化基本理念还未形成。这就导致了我国一方面真正具有核心竞争力的自主知识产权数量还很少,另一方面已有的知识产权资源流失又比较严重。我国要提高自主创新能力,建设创新型国家,就必须大力加强知识产权教育,增强知识产权教育的科学性和实效性,提高知识产权的意识,提高社会公众特别是市场主体和管理主体的知识产权素质,拓展知识产权创造、运用、保护和管理的能力。知识产权教育和文化战略是一项系统工程,具有基础性、艰巨性、长期性等特点。中国入世后,发达国家利用知识产权优势对发展中国家实施知识产权垄断的步伐正在加快,中国的发展越来越多地受到知识产权因素的影响和制约,知识产权教育与文化战略意义显得尤其重要。培养一大批具备知识产权专业素养的科技创新人才,提高全社会知识产权意识,是时代对我国当前知识产权教育提出的新任务。美、英、德、日等工业发达国家的大学中基本上都开设有面向全体大学生的“知识产权”教育课程。如2002年春,日本就提出“知识产权立国”的基本国策,包括四大战略:创新战略、保护战略、应用战略、人才战略。其中人才战略不仅包括知识产权专门人才的培养,也包括培养有知识产权基本素质的科技人才。韩国已在各类学校建立了125个发明实验班,进行发明创造训练和知识产权素质教育,培养未来的发明创新人才。2005年6月,世界知识产权组织(WIPO)知识产权教育和研究国际专题讨论会在日内瓦召开。来自全世界42个国家的与会者呼吁以更全面的方式开展并加强知识产权教育和研究工作,鼓励人们更广泛地认知、更有效地利用知识产权制度,从而促进经济、社会和文化发展。与会者还呼吁提供更多资源以支持中小学和大学的知识产权课程。知识产权从娃娃抓起,在小学就开始知识产权教育,让小学生从小就培养较强的知识产权意识,对我国今后公民知识产权素质的提升具有战略性意义。高校是知识产权教育的主阵地,知识产权素质应当成为其综合素质的一个重要方面。学校应当把学生科技创新能力培养作为应用型人才培养的重要内容来抓。企业是我国市场主体,知识产权竞争是企业核心竞争力的具体表现,当前我国60%企业没有申请专利,只有万分之三的企业拥有自主知识产权,大多数企业没有知识产权管理相关机构,企业知识产权意识还很淡薄,我国企业因知识产权纠纷赔偿额每年高达数百亿。加强企业知识产权教育,提高企业知识产权素质迫在眉睫。在党和国家的正确领导下,我国“三农”建设取得了一定的成效,在知识经济形势下,农民也必须提高知识产权素质,利用知识产权特别是农产品地理标志来取得更多的财富,创造更可观的经济效益。总之,构建我国知识产权教育与文化战略,在全国范围内提高中小学生、大学生、行政管理人员、企事业单位人员、农民、服务机构人员知识产权素质,是当前知识经济时代的必然选择,是实施国家知识产权战略的重要任务,是我国加快自主创新、建设创新型国家的重要目标。论文共分为七章,第一章为导论,阐述该论文的研究目的和意义、国内外研究现状、研究思路与方法、论文创新点等。第二章为知识产权教育与文化概述,阐述了该论文的相关理论和概念。第三章为知识产权制度、文化和教育的历史与现状分析,从知识产权制度与文化的历史分析,我国知识产权制度与文化现状分析,我国知识产权教育现状分析三个方面展开了研究。第四章为国外知识产权教育与文化实践,阐述国内外目前知识产权教育与文化现状及对我国的启示。第五章为构建我国知识产权教育与文化战略,明确了指导思想和基本原则,阐述了战略规划和战略专项任务,并提出了知识产权意识、知识产权价值观、知识产权文化、知识产权法律信仰、知识产权能力五个方面战略目标和实际成效。第六章为知识产权教育与文化战略绩效评价,从管理学的角度对上述知识产权教育与文化战略进行绩效分析。第七章为知识产权教育与文化战略实施措施,以高校、中小学、行政管理人员、企业、农民等社会主体为代表重点阐述了知识产权教育与文化战略实施措施。第八章为实证研究,以中兴通讯和武汉理工大学为实例阐述知识产权教育与文化实施取得的成效。文章涉及法学、管理学、教育学、政治学等多学科综合,运用了文献研究法、系统分析法、实证研究法、对比分析法、模型法、统计分析法、总结归纳法等方法。主要创新点表现在以下几个方面:第一、提出了我国知识产权教育与文化战略的规划和目标,分别从实现知识产权普及教育、专业教育和职业教育联动或互动,构建我国知识产权国民教育体系。实现人才培养、学术研究、社会服务和文化传承与创新的协调统一,营造我国知识产权文化氛围。实现知识产权教育、思想政治教育和素质教育的交相辉映,共同熔铸社会主义核心价值体系三个方面进行了阐述。熟悉一种制度,形成一种理念,培养一种能力,形成一套机制。第二、提出知识产权教育与文化战略的总体规划,即增强知识产权意识、树立知识产权价值观、培养知识产权法律信仰、培育知识产权文化、提高知识产权能力。第三、从管理学的角度构建模型对知识产权教育与文化战略进行绩效分析。第四、提出知识产权教育与文化战略的实施措施。

【Abstract】 Intellectual property is the personal and property rights of human intelligence work achievement given by the law. At present, the developed countries which take knowledge economy as the most important role.not only change intellectual achievements into commercial value and material wealth, but also pay high attention to intellectual property education and intellectual property culture. The cultivation of intellectual property talents, popularizing intellectual property knowledge, promoting intellectual property capabilities is as one of the important content of intellectual property strategy.In2005, In order to adapt to the development of the situation, China began to make intellectual property strategy. In2008, the State Council promulgated the Intellectual Property Strategy Outline which showed that opening course of intellectual property in colleges and universities, bringing intellectual property education into the College students’quality education system and fostering intellectual property culture and these are the key tasks of our country intellectual property strategy. Increasing the whole society’s awareness of intellectual property and forming the preliminary intellectual property culture atmosphere are recent strategic objectives.Because the knowledge property system and culture spread to china in the late qing dynasty, which is different from Chinese traditional culture, our country is lack of intellectual property in the aspects of system and culture, which affects intellectual property education and intellectual property culture in a certain extent, faced with many impacts and challenges.For example, the wholel society’s consciousness of intellectual property is still relatively weak, whether the market main body or management subject, their ability of creating, using and managing intellectual property protection are not strong and they don’t form the basic ideas of intellectual property culture about respecting knowledge, advocating innovation and law-abiding. Consequently, in our country, on one hand, the quantity of the turely core competitiveness of the independent intellectual property is small, on the other hand, the existing knowledge property resources are losing seriously. In order to improve the ability of independent innovation and building the innovative country, our country should strengthen intellectual property education, enhance the intellectual property education, improve the consciousness of intellectual property and improve the intellectual property quality of the social public, specially improve the market main body and the management main body’s ability of creating, applying, protecting and managing the intellectual property. The intellectual property education and cultural strategy is a system engineering featured with the traits of basic, difficulty and long-lasting. After China’s entry of WTO, the developed countries monopolize intellectual property in the developing countries by taking the advantages of intellectual property, China’s development is influenced and restricted more and more by intellectual property of the factors of intellectual property, as the result, intellectual property education and culture are becoming especially important.It is a new task, proposed by the current intellectual property education, for our country to cultivate a large number of innovation talents of science and technology who have the professional quality of intellectual property and enhance the whole society’s awareness of the intellectual property."Intellectual property" courses are basically opened for the college students in the universities of United States, Britain, Germany, Japan and other developed countries. Such as in the spring of2002, Japan proposed "the intellectual property builds a country" as the basic state policy, including four development strategies:innovation strategy, protection strategy, application strategy, talent strategy. Among them, talent strategy not only includes intellectual property special talent cultivation, but also includes training technology talents with basic quality of intellectual property. South Korea has set up125invention workshops in variety of schools to make inventions training and education of intellectual property quality in order to cultivate the future’s innovative talents. In June2005, the World Intellectual Property Organization (WIPO) set up the international symposium of intellectual property education and research in Geneva. The participants from all over42countries called for in a more comprehensive way to develop and strengthen intellectual property education and research work, encouraging more widely cognitive and more effective use of intellectual property system, so as to promote economic, social and cultural development. Participants also appealed for more resources to support the primary and middle school and university courses of intellectual property. Intellectual property grab from baby, which means that in elementary school intellectual property education is getting started to cultivate pupils’ consciousness of intellectual property when they are children. It has strategic significance to promoting the quality of citizens of our country in the areas of intellectual property in future.Universities are the main base of providing intellectual property education, intellectual property shall be an important part of comprehensive quality. Universities should treat the student’s science and technology innovation ability training as an important content of the application talents. Enterprise is the main body of our country’s market, intellectual property competition is the specific performance of core competitiveness among enterprises. In current, nearly60%enterprises in our country did not apply for patent. Only three over ten thousand of the enterprises have independent intellectual property, most enterprises without intellectual property management agencies. As the consciousness of knowledge property rights is still feeble in enterprises, the enterprises is amount to billions for intellectual property disputation every year in our country. To strengthen the education of enterprises’ intellectual property, it is imminent in improving the quality of the intellectual property of enterprises. Under the correct leadership of the party and the country,"agriculture, countryside and farmers" construction has made some achievements in our country. In the situation of knowledge economics, farmers also have to improve the quality of intellectual property, using the intellectual property to get more geographical indication of wealth especially in agricultural products, to create more considerable economic benefit.In short, to construct China’s intellectual property education and cultural strategy and to improve quality of intellectual property among primary and middle school students, college students and administrative management, enterprise or business the unit personnel, farmers, service personnel in the nationwide, is an inevitable choice in the era of knowledge economy in current, as well as an important task to carry out the national intellectual property strategy implementation, and is an important task in both speeding up the independent innovation and building an innovative country.This paper is divided into seven chapters. The first chapter is for introduction, expounding the research purpose and meaning, the domestic and foreign current research situation, the idea and method, the paper innovation points, etc. The second chapter is for intellectual property education and cultural overview, expounding the related theories and concepts. The third chapter is for the history and present condition analysis about intellectual property system, culture and education. It analyzed three aspects of the research from intellectual property system and culture history, our country’s intellectual property system and cultural situation, and our country’s present situation in intellectual property education. The fourth chapter is for the practice of intellectual property education and cultural in foreign countries, expounding the current intellectual property education and culture situation at home and abroad and their inspiration to China. The fifth Chapter is for the construction of intellectual property education and culture strategy in our country, making clear guidelines and basic principles and expounding the strategic planning and strategy special task. And it also puts forward five aspects of the consciousness of intellectual property, intellectual property values, intellectual property culture, intellectual property law belief, intellectual property capabilities, with strategic objectives and actual effect. The sixth chapter is for performance evaluation of intellectual property education and culture strategy, providing the analysis of intellectual property education and culture strategy to conduct the performance from the angle of management. The seventh Chapter is for intellectual property education and culture strategy implementation measures, taking colleges, primary and middle schools, administrative management, enterprise, the peasants and other social main body as represents to expound the implementation measures in intellectual property education and culture strategy. The eighth Chapter is for empirical research by lifting ZTE and Wuhan University of Technology as examples of implementation achievement in intellectual property education and cultural.The article involves law science, management science, education science, political science and so on, and uses the literature methodology, system analysis, empirical research, comparative analysis, model method, statistics analysis and summary induction method. The main innovation points is in the following respects. First, put forward strategy planning and the goal of the intellectual property education and culture in china, constructing the national education system of intellectual property in China respectively from the popularizing intellectual property education, professional education and vocational education linkage or interaction. Unified personnel training, academic research, social services and cultural inheritance and innovation, and create cultural atmosphere of intellectual property in China. Coordinate intellectual property education, ideological and political education and quality education, and establish the socialist core value system. Familiar with a set of system, form a kind of idea, cultivate a kind ability, form a suite of mechanism. Second, put forward strategy planning of the intellectual property education and culture, including strengthening awareness of intellectual property, setting up the intellectual property values and developing intellectual property law belief, cultivating intellectual property culture, improving the ability of intellectual property. Third, analyze the performance of intellectual property education and culturel strategy from the angle of management construct model. Fourth, put forward strategic measures of intellectual property education and culture strategy.
