【摘要】 最高人民法院院长王胜俊指出,“做好人民法院各项工作,重中之重就是加强队伍建设。必须采取更加有效的措施,全面提高法官队伍的政治思想素质和业务素质”。在社会转型时期,各种社会矛盾和纠纷日益凸显,如何通过高素质的法官队伍建设,为公众提供公正、高效、权威的司法服务,为国家政治稳定、经济发展、社会和谐提供有力的司法保障,不仅是司法管理者需要思考的问题,也是法学研究者应当进行理论探索的问题。为此,有必要对法官素质及其养成问题进行系统的研究。论文分为绪论、正文和结语。正文由七章(第2章至第8章)构成。第2章是法官素质养成的基本范畴。本章首先分析了素质和法官素质的基本内涵。然后,从政治素质、专业素质、业务素质、职业道德素质、人文素质、心理素质等方面阐述了法官素质的结构体系,并从业务素质养成的角度分析了法官素质结构的内在关系。在此基础上,该章分别研究了法官素质养成的价值目标、养成的路径、养成的阶段以及素质养成的影响因素等问题。第3章是法官政治素质养成的理论分析与制度创新。本章首先阐释了法官养成良好政治素质的意义以及法官政治素质养成的方式。然后,以美国、英国和德国为样本,对法官政治素质的域外情况进行了考察,并对我国法官政治素质养成的目标和基本要求进行了阐释。在理论分析的基础上,该章从政治素质培养起步较晚、培养制度不健全、政治素质养成缺乏考评机制等方面分析了我国法官政治素质养成中存在的问题。最后,提出了制度创新的构想,包括将法官政治素质的培养提前至法学教育阶段,完善法官政治素质的培养内容和方式,建立高水平的法官政治素质培养师资队伍以及构建法官政治素质的考评和激励机制等。第4章是法官专业素质的基本要求与养成模式。本章首先分析了法官专业素质的司法价值,并从信仰法律、精通法律、法律思维能力和表达能力等方面阐释了法官专业素质的基本要求。然后,对国外法官专业素质要求进行了解读。在此基础上,从法学教育、法官培训、法官自学等方面分析了我国法官专业素质养成存在的弊端,并提出了提高法官准入的学历层次、完善高校法学专业知识的培养制度、改革法官在职期间专业知识的培训制度、建立法官专业素质养成的激励机制等完善构想。第5章是法官业务素质的基本标准与培养路径。本章先从庭审驾驭能力、诉讼调解能力、事实认定能力、法律适用能力、裁判文书制作能力等方面阐述了法官业务素质标准。然后,解读了法官业务素质养成的路径以及该种素质的培养内容和方法。在理论阐释的基础上,该章反思了我国法官业务素质养成的现状,并从强化法学教育中法律职业技能的培养、改革法官遴选制度、改革法官业务素质教育培训制度、完善法官晋级晋职制度、建立法官交流任职制度、完善法官业务素质养成的奖励制度以及构建法官业务素质评价制度等方面提出了改革路径。第6章是法官职业道德素质养成的理论诠释与实践探索。本章首先分析了法官职业道德的特点以及职业道德素质的培养路径。然后,从忠诚司法事业、保证司法公正、维护司法形象、坚持司法为民、确保司法廉洁等方面对我国法官职业道德素质要求进行了解读。在此基础上,揭示了我国法官职业道德素质养成存在的不足,并提出了增设法官从业前职业道德素质培养的课程与训练、完善法官在职期间的职业道德素质培养制度、创新法官职业道德修养的引导机制等改革建议。第7章是法官人文和心理素质养成的理论与构想。本章在对法官人文和心理素质的理论进行阐释的基础上,从人文素质有待提升、心理素质普遍不高等方面对我国法官人文和心理素质现状进行了评析。从提升法官人文素质的措施、改善法官心理素质的路径等方面提出了促进法官人文和心理素质养成的构想。第8章是法官素质养成保障的基本理论与制度改革。本章首先从维护司法独立与公正、促进司法廉洁、防范司法腐败等视角阐述了建立法官素质养成保障制度的必要性。然后,分别解读了法官素质养成的物质保障、职务保障、监督惩戒保障的基本理论,分析了我国现行保障制度的弊端,并提出了制度完善的设想。更多还原

【Abstract】 Supreme People’s Court Chair Wang Shengjun pointed out that. "To complete well each work of People’s court, the most important work is strengthening the construction of judge troop. We must take a more effective measure, to enhance comprehensively the politics-thinking quality and the professional quality of judge troop". In the time of social reforming, all kinds of social contradiction and the dispute highlight day by day, how to construct the high quality judge troopis not only the question that the judicial superintendent needs to ponder, is also the question that the legal science researcher must carry on the theory exploration, so as to provide fair, highly effective, authority’s judicial service for the public, and to provide the powerful judicial safeguard for the national politics stablity, the economic development, the society harmony. Therefore, it is necessary that we conduct the systematic research for the judge quality and its traing.The paper divides into the introduction, the main text and the conclusion. The main text (the 2nd chapter to the 8th chapter) constitutes by seven chapters.The 2nd chapter is the basic category of judge quality training. This chapter first analyzes the basic connotation of quality and judge quality. Then, it analyzes structure system of judge quality from political fiberre, specialized quality, professional quality, occupational ethics quality, humanities quality, psychological quality and so on, and elaborates the intrinsic relations in the judge quality structure from the angle of professional quality training. On the basis of this, the chapter successively studies the value goal of judge quality training, the way of judge quality training, the stage of judge quality training, as well as the influencing factor of judge quality training and so on.The 3rd chapter is the theoretical analysis and institutional innovation of political quality training for judge. This chapter first explains the significance and way that the judges train good political fiberre. Then, the chapter inspects the political fiberre of foreign judge by taking the US, Britain and Germany as samples, and explains the goal and the essential requirements of which our country judge train the political fiberre. On the basic of theoretical analysis, This chapter analyzes the questions of that our country judges train the political fiberre, from the aspacts of which the training of judge political fiberre is late, the raising system is not perfect, the examination mechanism of political fiberre training lacks and so on Finally, this chapter proposes the conception of institutional innovation, including that makes raising political fiberre of judge ahead of the time at legal education stage, that consummates the training content and way of judge political fiberre, that establishes the high level’s teachers troop who train the political fiberre of judge, that constructs the examination and the incentive mechanism for the political fiberre of judge and so on.The 4th chapter is the essential requirements and training pattern of the specialized quality of judge. This chapter first analyzes the judicial value of specialized quality of judge, and explains the essential requirements of specialized quality of judge from the aspects of belief law, familiar law, ability to legal thought, and ability to legal expression and so on. Then, explaining the specialized quality request in overseas. Based on these This chapter analyzes the malpractice of the specialized quality training of judge in our country from the aspects of legal education, judge training, independent studying and so on, the chapter proposes the devises of system consummating, which cludes enhancing the school record level of judge admittance, perfecting raising system of specialized knowledge in university, reforming the training system of the specialized knowledge for judge during assignment period, establishing incentive mechanism of the specialized quality training for judge and so on.The 5th chapter is the primary standard and the raising way of professional quality for judge. This chapter first elaborates the professional quality standard of judge from the aspects of ability to control court, ability to lawsuit mediation, ability to recognize the fact, ability to apply law, ability to make legal document and so on. Then, the chapter explains the training way of the professional quality of judge as well as the content and method of professional quality raising, on the basis of explaining theory, the paper reconsiders the present situation of the professional quality training of judge in our country, and proposing the reforming way, which includes strengthening the legal vocational skill raising in legal education, reforming the choosing system of judge, reforming the system of the professional quality training for judge, consummating the promotion system of judge, establishing the exchange system of judge, consummating the incentive system of which judges train the professional quality,and constructing the evaluation system of professional quality for judge and so on.The 6th chapter is the theory annotation and practical exploration of the occupational ethics quality training for judge. This chapter first analyzes the characteristic of the occupational ethics of judge, and the way of occupational ethics quality training. Then, the paper explains the requirment of occupational ethics quality of judge in our country from the aspects of loyalty to judicial enterprise, keeping judical fair, maintenance of judicature image, the judicature servicing the people, guaranteing the judicature incorruptible and so on, The paper studies the insufficiency of the occupational ethics quality training for judge in the present, And it proposes the reforming suggests, which includes adding raising curriculum and its training of the occupational ethics quality before being engaged in the judge occupation in school of law, consummating the judge raising system of the occupational ethics quality during one’s term, innovating the training guidance mechanism of occupational ethics for judge and so on.The 7th chapter is the theory and conception of humanities and psychological quality training for judge. This chapter first explains the theory of humanities and psychological quality. Then, the paper evaluates the present situation of humanities and the psychological quality in our country from the need of promoting humanities quality, and that the psychological quality is generally not higher. The paper proposes the promoting conception for the humanities and the psychological quality training of judge from the aspacts of the measure of promoting judge humanities quality, the way of improving judge psychological quality and so on.The 8th chapter is the elementary theory and system reformment of the quality training safeguard for judge. This chapter first elaborates the necessity that establishes the safeguard system of judge quality training from the angles of maintenance jurisdiction independence and fair, promotion of judicature incorruptible, guarding judicature corruption and so on. Then, the paper explains elementary theory of the material safeguard, duty safeguard, surveillance and punishment safeguard which needs in judge training quality, and the paper analyzes the present malpractice of safeguard system in our country, proposes the mentality of system perfecting更多还原
