从《鹿特丹规则》之新立法评析台湾《海商法》未来修法之方向

【摘要】 承运人系履行国际货物运输合同之重要主体,本文主要系针承运人之责任制度来进行研究,并从国际间最新立法《鹿特丹规则》就现行台湾“海商法”关于承运人之责任制度来进行检视。文章共分为五章。第一章为绪论,介绍了本论文之研究动机以及目的、文献探讨、研究方法和预期之效果。第二章为说明承运人之责任归责原则、范围与立法模式作一分析,并对于原有海上货物运输公约以及《鹿特丹规则》就承运人责任规范,包括其除外风险、责任期间、责任限制、迟延交付作一比较。《鹿特丹规则》增加了承运人的责任与义务,可能会使其面临哪些操作上之困难,这些义务能否有条件地加以排除等,均为本章节所欲探讨之重点。第三章则是针对台湾现有“海商法”规定作一分析,从其立法沿革以及修法过程中归纳整理出其系继受哪些国际货物运输公约之规范?采取何种标准识别承运人;又承运人之责任理论与司法实务实证中,有哪些矛盾与缺失。第四章则是藉由与大陆海商法与台湾“海商法”中承运人责任规范作一比较后,借鉴大陆主管部门为应对《鹿特丹规则》之新立法,学者间以及论者认为可以修改调整之修法要点。第五章整合前述之归纳,提出台湾“海商法”为适用《鹿特丹规则》承运人责任条款如何调整,以及其影响到之相关当事方如何调合,提出未来修改方向与建议条文及理由。

【Abstract】 This essay is mainly studying the carrier’s liability system, which are counterparts of performing international carrying of goods contracts. By doing so, this essay discusses the foundment of carrier’s responsibility from the perspective of recently adopted Rotterdam Rules, R.O.C Maritime Laws and related regulations.This essay is split into five chapters:Chapterl:This chapter is apreface, introducing the motivation, purpose, document, method and expected effection.Chapter2:This chapter elaborate analysis of carrier’s responsibility, and its foundment and regulation system from Rotterdam Rules and other international carrying of goods conventions,including comparison between international carrying of goods conventions on the exception of risk,the period of carrier of responsibility, and the delay of different convention. Rotterdam Rules has expanded forwarder’s obligation and responsibility, which might put it encountering harshness of implementation. Can these obligations be conditionally exempted and the above mentioned would be points of this chapter.Chapter3:This chapter focuses on analyzing ongoing R.O.C Maritime Law, inducing and summarizing what international carrying of goods convention it inherits from regulation history and amendment process of law. The criteria it adopts to recognize carrier; contradiction and insufficiency between carrier’s responsibility theory and judiciary practice.Chapter4:This chapter compares regulations of carrier responsibility in both active P.R.O.C and R.O.C Maritime Law. In order to the implementation of Rotterdam Rules, what amemdment could the corresponding part of active P.R.O.C Maritime Law make.Chapter5:This chapter addresses how Taiwan could adopt Rotterdam rules advanced new legislation? Recommends amendment clauses and reason according to problem between practice and theory of carrier responsibility clause.
