新时期乡村题材法制电影研究

【摘要】 本文的重点是对1979—2008年间中国乡村题材法制电影作研究。此30年对应中国改革开放的历程,法制电影的数量与日俱增,特别是其中的乡村题材法制电影的数量也呈不断上升的趋势,据统计,30年间,中国共生产了904部法制电影,其中包括132部乡村题材法制电影。新时期以来,乡村题材法制电影不仅数量上有增长,其质量、内容、意义也都在发生着巨大的转变,这无论对中国电影业还是对中国法制社会进程都产生了不可估量的影响。在梳理了30年间法制电影和乡村题材法制电影名单与电影内容的基础上,论文先对新时期以前的中国乡村题材法制电影进行了发展脉络的梳理,大致分为了三个阶段,即1949年新中国成立前的乡村题材法制电影、1949年至1966年新中国成立后的“十七年”乡村题材法制电影和1967年至1976年“文化大革命”时期的法制电影。论文的正文部分从以下五个章节进行展开:第一章对30年间中国乡村题材法制电影的发展态势进行了分析,从中探索其发展规律。即此30年中国乡村题材法制电影发展态势如何,这些乡村题材法制电影呈现出什么面目,又经历了哪些变化。以30年乡村题材法制电影名单和统计数据为依据,可直观地划分为三个阶段:1979—1991年乡村题材法制电影的自觉创建期;1992—2000年是乡村题材法制电影的发展变革期;2001—2008年是乡村题材法制电影的繁荣多产期。第二章探讨乡村题材法制电影为什么会发生这样的变化,本文从中国社会30年发展变化的宏大背景中考查乡村题材法制电影变化的原因。从电影体制的改革创新到法律体系的发展完善再到社会文化的更新进步,透过这些角度详解30年来乡村题材法制电影的变化成因,从而观照社会背景对传播系统所带来的影响。第三章通过新时期乡村题材法制电影的发展态势和原因分析,探究其体现出的特点和正反两方面的传播作用。其特点主要表现为:创作过程是从自发走向自觉,新的法律产生既对乡村题材法制电影的创作产生影响,反过来它又推动了中国法制化进程;讲“人情”重于讲“法理”;影片关注“人”胜于关注“法律”;表现“乡村”多于表现“法庭”。新时期乡村题材法制电影的传播作用主要有:认识作用、警戒作用、疏导作用和建设作用。同时,也要规避其可能带来的负面影响,这主要包括:诱发作用、模仿作用、破坏作用和异化作用。第四章,从影像叙事入手,分析新时期乡村题材法制电影为了实现其传播作用,通常呈现哪种类型的“故事”?又是习惯于按照哪种组织方式“结构”,以何种方式加以表达的?本章共分为两节:第一节,从叙事主题的角度探索与思考新时期乡村法制现状。在呈现“乡村”这一封闭空间的时候,新时期乡村题材法制电影叙事主题多以展现“人情”与“法理”之间的矛盾;“乡村”也在不断地受到“城市”的强烈冲击,“城市”成为了“乡村”这个共同体逐渐解构的一个最重要的因素,新时期乡村题材法制电影既表现了城乡之间价值观念的冲突,也表现了行为方式的差异;同时,新时期乡村题材法制电影叙事主题还关注如何协调城乡二者之间的矛盾与冲突,从而成功建立乡村社会法治秩序。第二节,从新时期乡村题材法制电影的叙事结构着手,分析在电影文本表层结构与深层结构的支配下,中国乡土社会的法治秩序是如何被建构的。在叙事的表层结构方面,我们将乡村题材法制电影的主要要素抽取出来进行分析,研究其相互之间的关联,分析这些相似的人物角色设置、人物功能、情节发展、矛盾冲突等是如何承担着重要的叙事功能的;在叙事的深层结构方面,对新时期乡村题材法制电影秩序价值、正义价值的实现和价值的冲突与消解。第五章考察法律文化是如何在乡村题材法制电影中得以体现的。从主旋律影片和娱乐性影片两个层面考察其对法律文化主导性和大众性特点的传播。最后,对全文进行总结,指出乡村题材法制电影在新时期30年的发展历程中,取得了辉煌的成就,在帮助农民法律意识的觉醒,促使乡土社会法制化建设等方面发挥了至关重要的作用,它不仅真实地反映了乡土社会的世态民生,而且作用于乡土社会,影响乡土社会。要努力使乡村题材法制电影的法律文化面貌符合全人类的法律价值取向,使其以独特的民族面貌更好地走向世界。目前国内外还没有专著对新时期乡村题材法制电影作专门性研究,笔者在搜集了众多第一手的乡村题材法制电影资料的基础上,以中国社会体制演变、电影行业体制改革及影像叙事的角度对乡村题材法制电影进行研究,具有一定的创新性及综合性。

【Abstract】 This article focused on the years of 1979-2008 Chinese rural legal films for research subjects.This 30 years of China’s reform and opening-up process corresponding to the increasing number of legal movies, especially the rural subjects, the number also shows the rising trend. According to the statistics,30 years,904 Chinese legal movies were produced, including 132 rural subjects. The new period, rural legal movies not only quantity increases,but also its quality, content, meaning occurs a huge change, in the Chinese movie industry or whether to social progress of China’s legal system have a immeasurable influence.Based on combing the 30 years legal movies and rural subjects list and movie content, the paper first combs the Chinese rural legal movies before the new period and divides them into three stages, namely, new China was founded in 1949; the rural legal movies of 1949-1966, meaning "17 years"; 1967 to the 1976 "culture revolution" period of legal movies. The text of papers starts from the following five chapters:The first chapter analyzed 30 years of Chinese rural subjects legal movie development trend, from which to explore the law of development. Namely, how was the 30 years China rural subjects legal movie development situation, what appearance these rural subjects legal movies showed, and experienced what changes. For 30 years rural subjects legal movie list and statistical data as the basis, can directly into three stages:1979-1991 rural subjects of legal film self-consciously; create period 1992-2000 was the development of rural subjects legal movie transformation time; from 2000 to 2008 is the prosperity of the country subject legal movies period.Chapter 2 discusses why rural subjects legal movies would happen.This article searched the reason for the variation of the legal movies, from the grand background of Chinese society development and change in 30 years. From the reform and innovation of film system to the developing and perfecting of law system to the update progress of social culture, through these angles, sep 30 years of rural subjects legal movies, which reflect on social causes changes in communication system background to the impact.Chapter 3 through the new period of rural subject legal movie development trend and cause analysis, probe into its reflecting the characteristics and the spread of western role. Its features:creative process is from spontaneous to self-consciousness, new laws produced influence to the creation of the rural subjects legal movies, which has in turn promote Chinese legalization; speak "human" over speak "legal"; "person" attention is better than "legal" attention; performance "country" more than performance "court" The major communicating functions of the rural subjects legal movie in the new period include:knowledge functions, alert function, facilitating role and construction effect. At the same time, also avoides the potential negative effects:induce function, imitate function, damage and alienation effect.The fourth chapter, starting from image narrative, analyzes the rural subjects legal movie in order to realize its role, usually present spread what type of "story"? What kind of organization is used to according to means "structure", in what way to express?This chapter is divided into two quarters:the first quarter, from the angle of narrative theme, explores the country legal status quo thinking in the new period. In the present "country"-the enclosed space, new period of rural subjects legal movies narrative theme show more contradictions between "human "and" legal ";"country" is constantly influenced by the "city’"s strong impact, "city" became "country" this community, one of the most important gradually deconstruction of factors, the new period rural subjects legal movies not only showed the values conflict between urban and rural areas, but also showed behavior of the differences. Meanwhile, the narrative theme of new period rural subjects legal movie is concerned how to coordinate the contradiction and conflict between urban and rural areas, and to build a successful rural social legal order.The second quarter, from the narrative structure of new period of rural legal movies, analyzes how is the order of the Chinese native society of rule of law construction, in the film text surface structure and deep structure’s domination. The surface structure in narrative, we will extract out main elements of rural subjects legal movies for analysis, study the connection between each other, analyze how these similar characters settings, characters function, plot development, conflict etc undertaking important narrative function; the deep structure in narrative, research the order value and justice value realization of new period rural subjects legal movie, and the value of conflict and digestion.Chapter 5 examines how the legal culture represented in rural subjects legal films. From two aspects:the matic films and entertaining films, research examins the spread of legal culture of guidance and general audience characteristics.Finally, summary of full text points out that the creation of the rural subjects legal movies should be multidimensional, rural subjects to the understanding of legal movie significance should also be multidimensional, and it will provide people with more utterance possible. On this basis, this paper tries to draw the new communicating mode of rural legal films.There is no book at home and abroad for professional research in the new period rural subject legal films, on the basis of collecting many materials of first-hand rural subject legal films, research from the angle of China’s social system evolution, the film industry system reform and image narrative, having the certain innovation and comprehensive.
