【摘要】 文物旅游资源具有十分重要的经济、文化、科研、美学价值,是属于人类的宝贵财富。然而,文物旅游资源和其它一些资源一样属于难以再生或不可再生的资源,对它的开发、利用和保护等问题,关系到一个国家、地区的旅游业和经济的发展。近年来,我国虽然比较重视文物旅游资源的保护,但是,某些地方在文物旅游资源的开发过程中,片面追求轰动效应,重开发,轻保护,使一些颇具特色的文物旅游资源逐渐丧失生命力,特别是一些不可再生的珍贵文物旅游资源过早衰竭,造成不可弥补的损失。因此,必须对文物旅游资源的开发保护给予高度的重视,在我们大力开发利用文物旅游资源的同时,应使保护文物旅游资源成为一个长期性的工作和使命,本文即对我国文物旅游资源开发与保护法制的完善问题进行了专题研讨。 全文共分五部分。第一部分阐述了文物旅游资源的基本理论,主要介绍了文物旅游资源的基本概念、特点、文物旅游资源的可持续发展及其开发模式,并对文物旅游资源进行法律保护的必要性作了分析。第二部分分析了目前我国文物旅游资源的开发现状、存在问题及其原因。第三部分对我国文物旅游资源保护的法制现状进行了分析,既肯定我国文物旅游资源法律调整的一面,又着重对我国文物旅游资源保护法律中存在的主要问题进行了剖析。第四部分介绍了日本、意大利的文物保护情况和联合国对文化遗产的法律保护以及由此引出对我国文物旅游资源开发与保护的几点启示。第五部分借鉴国外文物旅游资源开发与保护法律更多还原

【Abstract】 The tourism resources of cultural relics are human being’s treasures because they are of great siganificance to economics, culture, scientific research and aesthetics. However, the tourism resources of cultural relics, like all the other resources, are kind of eternal resources. The exploitation and protection of those resources concern the development of tourism and economics of a region and a nation as well. Though we have paid more attention to the protection of the tourism resources of cultural relics in recent years, the blind exploitation and the ignorant protective consciousness have drained their vitality and done serious damage especially to the inproductive precious relics. Therefore, we have to place great emphasis on explotation and protection of the tourism resources of cultural relics. While exploiting and utilizing these resources, we expect to protect them in the long term. This paper attempts to discuss specially the improvement of the legal system with respect to the exploitation and protection of the tourism resources of cultural relics in China.This paper consists of five chapters. Chapter one expounds the basic theory of tourism resources of cultural relics. It includes the basic concepts, pecularities, sustained development and development model, and it analyses the necessity of the legal protection of those resources. Chapter two focuseson their present status, the existing problems and the possible reasons for them. Chapter three deals with the present legal system of the protection of the tourism resources. It first affirms the law on adjustment to this issue, and then points out the main problems that go with it. Chapter four shows the legal protection in Japan, Italy and UN, and the inspiration for China. Chapter five, based on the fruits of other countries and our own practical situation, suggests the ideas to promote the present legal systems with respect to the protection of the tourism resources of cultural relics. At present, although we have drafted related law on the exploitation and protection of the tourism resources, the advanced development of relics traveling industry brings with it problems of legislation, administration system and enforcement law in the law system. In order to effectively exploit and protect the tourism resources of cultural relics, the writer adopts the comparative and logical approaches to analyze the existing problems and on the basis of it proposed efficient legal methods to ensure the sustained development of the tourism economics.更多还原
