【摘要】 《政府采购协议》(The Agreement On Government Procurement,简称GPA)是WTO下规范政府采购行为的诸边贸易协议。GPA试图将国际贸易中的公平竞争机制引入政府采购领域,完善各国政府采购制度,以使各国政府都能够在公平的环境下参与国际的政府采购。随着我国政府加入GPA谈判步伐的加快,按照财政部的部署,根据《2012年中部10省主要经济指标和排序表》,吉林省属于中部地区第三批次(最后批次)列入GPA出价范围的省份。但是由于吉林省公共基础工程技术水平相对落后,地缘优势又不明显,政府采购方面理论研究较为匮乏,因此,要想在加入GPA后引进国际先进工程技术和人员,最大限度维护吉林省的利益,就要通过建立起健全的政府采购法规制度、充分利用GPA的例外条款来加以实现。加入GPA将对吉林省的政府采购市场带来冲击,将对吉林省的外贸进出口、招商引资和国际合作产生重大影响,吉林省政府应该如何采取有效的措施积极应对,值得思考和研究。因此,本文通过对GPA的最新发展趋势和吉林省公共基础工程政府采购现状的研究,分析出当前吉林省公共基础工程加入GPA存在着政府采购法律体系不健全、政府采购运行监管不到位、公共工程政府采购机制不科学、公共工程政府采购人员专业水平较低、对GPA规则不甚了解等问题。在借鉴美国、欧盟和日本等GPA参与国经验和做法的基础上,总结对吉林省公共基础工程加入GPA的启示,并提出吉林省公共基础工程加入GPA的对策建议:完善政府采购相关法律法规、加大吉林省公共基础工程政府采购监管力度、组建吉林省GPA领导小组、坚持循序渐进的开放思路、熟悉使用GPA规则寻求保护、严格遵守政府采购国际市场规则、培养政府采购专业人才等。更多还原

【Abstract】 The Agreement On Government Procurement(GPA)is The trade Agreement that regulates Government Procurement behavior under The WTO.GPA is trying to introduce the mechanism of fair competition in the international trade field of government procurement,improve the government procurement system,so that the governments are able to participate in the international government procurement in a fair environment.The quickening pace of our government to join GPA negotiations,in accordance with the deployment of the ministry of finance,according to the main economic indicators in 2012 10 provinces in central and sorting table,central Jilin province belongs to the third batch(last batches)included in the GPA offer range of provinces.But due to the common base of Jilin province engineering technology level is relatively backward,geographical advantages and is not obvious,the government procurement theory research is relatively scarce,therefore,to the GPA accession after the introduction of international advanced engineering technology and personnel,and safeguard the interests of the Jilin province to the greatest extent,by set up a sound system of government procurement laws and regulations,make full use of exception clause of the GPA.The entry of GPA will bring impact on the government procurement market in Jilin province.It will have a great impact on the import,export,investment and international cooperation of Jilin province.It is worth thinking and studying how the Jilin provincial government should take effective measures to deal with it.Therefore,through the study of the latest development trend of GPA and the status of government procurement in Jilin public infrastructure project,this paper analyses that the current public infrastructure project of Jilin province is not perfect in the legal system of government procurement,the management of government procurement is not in place,the procurement mechanism of public engineering government is unscientific,and the public engineering administration is in government.Government procurement personnel have lower professional standards and less understanding of GPA rules.On the basis of the experience and practice of GPA participating countries such as the United States,the European Union and Japan,this paper summarizes the enlightenment to the public basic project of Jilin Province,and puts forward the suggestion of the accession of the public basic project of Jilin province to the GPA: perfecting the relevant laws and regulations of the government procurement,strengthening the supervision of the government procurement of the public infrastructure project in Jilin Province,and establishing the government procurement.Jilin GPA leadership group,adhere to the gradual opening of the train of thought,familiar with the use of GPA rules to seek protection,strict compliance with the government procurement of international market rules,training government procurement professionals and so on.更多还原
