【摘要】 随着《中华人民共和国长江保护法》《中华人民共和国黄河保护法》等法律的颁布，特殊地理区域保护立法逐渐成为我国生态环境保护领域立法的新动向。面对一种新类型的环境保护立法，对其基础范畴的研究必不可少。然而，通过梳理文献发现，当前特殊地理区域保护立法存在着概念界定不清、功能定位不明、体系定位不显等问题。为此，应当采用“特殊地理区域保护法”的表述化解概念纷争，从本质特征与类型化分析入手明确特殊地理区域保护立法内涵与外延；从政治逻辑、生成逻辑、现实逻辑等方面阐述特殊地理区域保护立法的功能定位；从探析特殊地理区域保护法对环境法律体系产生的影响以及与其他环境法律规范的关系等来确定特殊地理区域保护立法的体系定位，并明确其体系化路径，进而为特殊地理区域保护立法提供一定的理论支撑。更多还原

【Abstract】 With the promulgation of laws such as Yangtze River Protection Law of the People’s Republic of China and Yellow River Protection Law of the People’s Republic of China, legislation on the protection of special geographical regions has gradually become a new trend in the field of ecological environment protection in China. Facing a new type of environmental protection legislation, it is essential to carry out a research on its basic categories. However, through literature review, it is found that there are problems such as obscure conceptual definition, unclear functional positioning, and unclear system positioning in the current legislation on the protection of special geographical regions. Therefore, it is suggested to take the expression of “Special Geographical Regions Protection Law” to resolve conceptual disputes, and to clarify the legislative connotation and extension of special geographical regions protection from the essential characteristics and typology analysis. And the functional positioning of legislation for the protection of special geographical regions should be elaborated from the perspectives of political logic, generative logic, and practical logic. The system positioning of legislation for the protection of special geographical regions can be determined by analyzing its impact on the environmental legal system and its relationship with other environmental legal norms. And its systematic path should be clarified so as to provide certain theoretical support for legislation for the protection of special geographical regions.更多还原
