【摘要】 在全球信息化的发展过程中,公共借阅权制度有全球普及的趋势。为了争取主动,建立符合我国国情的PLR系统,文章从公共借阅权的权利性质、权利主体、补偿方式三个方面对公共借阅权进行了讨论。认为根据我国国情,公共借阅权应定义为一种求偿权,不宜将出版机构纳入权利主体的范围内,可以用多元化的方式对著作权人进行补偿。更多还原

【Abstract】 Public Lending Right system has a trend of global popularization in the process of global informatization.In order to wrest the initiative and set up a PLR system which is in accordance with China’s national condition,this paper analyze public lending right from three angles: the nature of public lending right、 the subject of public lending right and the compensation mode of public lending right.This paper considers public lending right should be defined as a right to recourse,except publishing agency,but the compensation mode of public lending right should be diversification.更多还原
