【摘要】 [研究目的]数字经济时代，数据隐私保护与反垄断监管之间的交集与冲突将产生新的监管协同问题。为此，亟需明确数据隐私保护与反垄断监管的协同基础并构建协同机制。[研究方法]通过案例分析与比较研究等方法，结合德国、法国、英国等最新典型案件，对同时造成数据隐私损害与竞争损害、提升数据隐私保护水平但有损市场竞争、提升市场可竞争性但危及数据隐私保护的行为展开类型化分析，归纳并阐述域外司法辖区处理数据隐私保护与反垄断监管协同问题的有益经验。[研究结论]就经济理据而言，数据隐私保护与反垄断监管的协同实施有助于克服信息不对称与市场力量不对称所引发的“双重市场失灵”;就价值理据而言，数据隐私保护所主张的个人自治与数据利用平衡立场与反垄断监管所倡导的消费者选择与经济效率多元目标之间存在高度契合。在此基础上，可从规则衔接与冲突化解方面进一步推进数据隐私保护与反垄断监管的协同实施。更多还原

【Abstract】 [Research purpose] In the era of digital economy, the intersection and conflict between data privacy protection and anti-monopoly regulation will generate new regulatory collaboration issues. For this reason, it is urgent to clarify the basis of synergy between data privacy protection and anti-monopoly regulation so as to construct a collaboration mechanism. [Research method] Through case studies and comparative studies, this study analyzes the latest typical cases in Germany, France and United Kingdom, elaborates and summarizes different types of behaviors that could harm data privacy and competition simultaneously, or promote data privacy while harming market competition, or enhance market contestability while harming data privacy, in order to present a typology of regulatory collaboration.[Research conclusion] In terms of the economic rationale, the synergistic implementation of data privacy protection and anti-monopoly regulation can help overcome the "duel market failure" caused by asymmetry of information and market power; In terms of value rationale, the balance between personal autonomy and data utilization advocated by data privacy protection, and the protection of consumer choice and economic efficiency advocated by anti-monopoly regulation are highly compatible. On this basis, the synergistic implementation of regulation can be further advanced in terms of rule convergence and conflict resolution.更多还原
