【摘要】 刑法行为理论发展至今,主要形成自然行为论、社会行为论、目的行为论及人格行为论。这些行为学说不乏合理元素,但亦充斥着纰漏与弊窦,难以自圆其说,故以人类劳动样态为出发点,缔造控制行为论,该行为理论能够对不作为犯罪与过失犯罪进行有效统摄,亦能涵摄罪前罪后情节,从而使行为的概念具有了统一性的功能。更多还原

【Abstract】 Criminal law circle at home and abroad has put forward four criminal behavior theories:theory of spontaneous behavior,theory of social behavior,theory of purpose behavior and theory of personality behavior.The aforesaid four theories do have reasonable elements in them,but there are defects,too.Therefore it is necessary to improve criminal behavior theory based on human labor,which has uniform function.The improved criminal behavior theory,the theory of criminal behavior control,unifies the concept of behavior and covers crimes of omission and crimes of negligence,subsume circumstances both before and after crimes更多还原
