法律的经济分析的基本理论预设

【摘要】 法律的经济分析的基本理论预设有哪些?学界对此尚无定论。在方法论上的个人主义和经济分析的两大命题的指导下,法律的经济分析的理论预设主要有:理性的人、理性的法律,"类市场行为"与市场行为同样是追求效益最大化的理性"行为",市场运作总会趋向"均衡"状态。

【Abstract】 No final conclusion has been reached on what the basic theoretical presumption of the economic analysis of law in the academic field. This paper put forward some main presumptions of the economic analysis of law.
