【摘要】 党的十九届五中全会审议通过的《中共中央关于制定国民经济和社会发展第十四个五年规划和二〇三五年远景目标的建议》,专门对“完善现代金融监管体系”的工作作出了全面部署,这对于保障广大被保险人和投保人的切身利益,进一步健全和完善我国保险业监管体系,促进金融业健康发展具有重要意义。论文在介绍了我国保险业监管基本概况:监管主体、客体、目标和原则、手段、形式以及内容的基础上,梳理了现阶段我国保险业监管的主要政策,指出监管中存在的主要问题是:监管过程中信息披露不充分、对保险公司偿付能力监管不足、分业监管下监管部门职责不够明确、保险监管体系不完善,并对这些问题的可能原因进行了分析。通过借鉴德国保险监管法律体系、新加坡RBC2监管规则、英国保险科技监管和美国混业监管模式等国外保险监管经验,从保险业监管制度、保险偿付能力监管、保险监管数字化技术和现代大金融协同监管体系等方面提出完善我国保险监管的对策建议。更多还原

【Abstract】 The Party leadership’s proposals for formulating the 14th Five-Year Plan(2021-2025)for National Economic and Social Development and the Long-Range Objectives Through the Year 2035 were adopted at the fifth plenary session of the 19th CPC Central Committee,and a special deployment was made on the "Improvement of Modern Financial Regulatory System",which is of great significance to protect the interests of the insured and policy-holder and further improve China’s regulation system of the insurance industry and financial industry.The paper introduces the basic situation of China’s insurance supervision:the supervisory agency,object of supervision,goals and principles,means,forms and content,on which it reviews the current policy of the insurance regulation in our country.It also points out the main problems existing in the regulation,which include inadequate disclosure of information in the process of regulation,insufficient regulation over solvency to the insurance company,unclear duty division under the departments of separate supervisory system and imperfect insurance supervisory system.Then the possible reasons for these problems are analyzed.By drawing lessons from Germany,Singapore RBC2 insurance supervisory regulations,insurance regulation of science and technology in England,the integrated supervision mode in USA and other foreign insurance supervision experience,the paper puts forward countermeasures and suggestions of perfecting our country’s insurance regulation from the perspective of insurance,insurance solvency supervision system,insurance supervisory digital technology and modern financial collaborative supervision system.更多还原
