大连市农村集体经营性建设用地入市研究

【摘要】 自党的十八大以来,随着新型城镇化的飞速推进,农村土地制度的改革也在不断探索深化。在我国广大的农村地区,依然存在着很多低效使用的集体建设用地,而农村集体建设用地能否实现有效利用是决定我国农村城镇化进程的关键,农村集体经营性建设用地入市对我国经济的可持续发展、农村改革等具有重要作用。大连市是北方重要的港口城市,因其地形三面环海,故土地资源异常珍贵。近年来大连市国有用地供地数量逐年减少,2015年国有用地全年供给数更是达到历史最低点。在北京市大兴区等33个行政区(县)进行集体经营性建设用地入市试点后,如何高效有序、规范引导经营性建设用地入市己经成为大连市重点研究的问题。论文在剖析农村集体经营性建设用地入市背景、阐述农村集体经营性建设用地的概念和理论的基础上,对大连市集体经营性建设用地的基本情况及存在问题进行分析,并借鉴试点城市做法,提出大连市集体经营性建设用地入市的对策建议。首先,全面论述大连市集体经营性建设用地基本情况及集体经营性建设用地入市的必要性和作用,并分析查找大连市农村集体经营性建设用地入市过程中存在的关键问题。当前问题表现为法律法规不健全、抵押融资困难、指标空间减少及收益分配政策不健全、管理机制不完善等。其次,在实地调研基础上,分别列举了北京市大兴区及庄河市等典型试点城市的做法,对入市方法进行总结与梳理,学习借鉴其成功经验。最后,根据成功入市城市的经验,针对大连市集体经营性建设用地入市的制约因素,提出了大连市开展集体经营性建设用地入市的工作实施方案和对策建议,包括:推进改革力度,尽快出台相关法律文件;加快土地金融市场改革,破解抵押融资约束;拓展“城乡增减挂钩”方式,鼓励各种创新行为;建设城乡统一市场体系,切实保障农民权益等。
【Abstract】 Since the 18 th Party Congress,with the rapid development of new urbanization,the reform of rural land system has been exploring and deepening.There are still a large number of collective operating construction land in the vast rural areas of our country.Whether the rural collective construction land can be used effectively is the key to determine the process of rural urbanization in our country.It plays an important role in the sustainable development of social economy and rural reform.Dalian is the most important port city in the north.In recent years,the number of state-owned land supply has been decreasing year by year,and the total number of state-owned land supply in 2015 has reached the lowest point in history.After carrying out the pilot project of collective management construction land in 33 administrative regions(counties),such as Daxing District of Beijing,how to efficiently and orderly supply land,Standard guide management construction land into the market has become a key issue in Dalian.On the basis of analyzing the background of the rural collective management construction land entering the market,this paper expounds the definition and theory of the rural collective management construction land,and expounds the basic situation and existing problems of the rural collective management construction land in Dalian.Combined with the pilot practice of the pilot city,the paper puts forward some suggestions on the construction land for collective operation in Dalian in the future.Firstly,it discusses the basic situation of collective operating construction land in Dalian and the necessity and function of collective management construction land entering the market,and analyzes the key problems existing in the process of finding out the rural collective operating construction land in Dalian.The main problems at present are the imperfect laws and regulations,the difficulty of mortgage financing,the reduction of index space,the imperfect policy of income distribution and the imperfect management mechanism.Secondly,it enumerates the practice and valuable experience of several pilot cities,and simply discusses and analyzes the situation of entering the market of the rural collective management construction land in Daxing District and Zhuanghe City according to the investigation and investigation.Summarizes and combs the different market entry method,studies and draws lessons from its successful experience.Finally,according to the experience of successfully entering the city,according to the restriction factors of Dalian collective management construction land entering the city,the paper puts forward the countermeasures and suggestions for Dalian to carry out the collective management construction land to enter the city: first,to promote the reform.To introduce relevant legal documents as soon as possible;second,to speed up the reform of the land financial market and break down the restrictions on mortgage financing;third,to expand the "urban-rural increase or decrease linkage" method to encourage all kinds of innovative behaviors;fourth,to build a unified market system between urban and rural areas.Finally,the paper puts forward the scheme of rural collective management construction land for reference in Dalian.
