【摘要】 20世纪70年代以来,世界各国都在不断进行刑罚制度的改革和创新,社区矫正就是在这样的背景下诞生的社会化行刑方式。近年来随着社区矫正工作的不断发展,如何采取有效措施加强对社区矫正执法权的制约逐步进入研究视野。浙江省舟山市从2006年8月开始社区矫正工作试点,作为全国唯一的群岛新区,舟山市社区矫正工作具有浓郁的地方特色,社区矫正执法监督实践中亟待解决的问题很多。本文从社区矫正执法监督等概念及相关理论研究出发,结合国内外社区矫正执法监督具体实践,分析了舟山市社区矫正执法监督存在的问题,在此基础上对舟山市社区矫正执法监督工作提出对策和建议。研究具有一定的理论价值和积极的实践意义。论文共分五个部分。第一部分是论文的选题背景和意义以及国内外研究现状；第二部分阐释了社区矫正执法监督等概念,并分析了相关理论基础；第三部分对舟山市社区矫正执法监督的现行举措、成果及存在问题进行分析解剖；第四部分引用了国内外关于社区矫正执法监督的做法,归纳并总结出可供借鉴的经验；第五部分是文章最重要的部分,对舟山市社区矫正执法监督工作提出具体的对策和建议,通过完善立法、加强内外部监督等有效举措,来推动社区矫正执法工作,促进社区矫正执法规范化。更多还原

【Abstract】 Since1970s, the reform and innovation of the penal system are developed constantly in the world and the community correction is a socialized criminal execution way which was born under the background. In recent years, with the continuous development of the community correction, how to take effective measures to strengthen the control of community correction enforcement gradually comes into the research vision. Zhoushan of Zhejiang Province began the work pilot of community correction from August,2006, as the only Islands District, the community correction of Zhoushan has strong local characteristics. There are many urgent problems in the practice of the law enforcement supervision of community correction. In this paper, starting with the conception and related theoretical study of the community-correction law enforcement supervision, combining with the specific practice from domestic and foreign countries, it analyzes the problems in the law enforcement supervision of Zhoushan community correction and put forward the relevant countermeasure and suggestion. The study has certain theoretical value and positive practical significance.This paper consists of five parts:the first part is the background and significance of this topic and the present situation of domestic and foreign research; the second part explains the concept of community correction law enforcement supervision and analyses the related theory; the third part analyses the current Zhoushan community correction measures, achievements and problems of the law enforcement supervision; the fourth part refers to the domestic and foreign community correction on the supervision of law enforcement practice, summarized and summed up the experience for reference; the fifth part is the most important part of the paper that it puts forward specific measures and suggestions to the supervision of Zhoushan community correction law enforcement through perfecting legislation, strengthening the supervision and other effective measures to promote the work and the standardization of community correction law enforcement.更多还原
