【摘要】 在"指数爆炸"的数字时代,技术赋能且赋权给传统法律监管带来前所未有的挑战,尤其是基于区块链技术衍生的内部私人仲裁系统呈现"司法化"特征,引发"链上仲裁"与传统争端解决机制的对立。为应对这一挑战,各国需从内部和外部合法性两方面做出努力:内部合法性方面,从区块链内部赋予政府超级节点特权,并对仲裁系统的自动化决策设定必要限制;外部合法性方面,根据案件类型构建链上链外分工合作机制,并加强国际对话推动建立全球共识机制。中国需加强区块链"司法化"相关标准的研究,积极参与国际对话,提升国际话语权和规则制定权,推动数字时代立法向更加公平的方向发展。更多还原

【Abstract】 In the digital era of "exponential explosion", the empowerments of blockchain technology have brought unprecedented challenges to traditional legal supervision. In particular, the private arbitration system derived from blockchain technology is developing toward "judicialization", which has triggered conflict between internal adjudication system on blockchain and the traditional dispute resolution mechanism. In order to mitigate these challenges, measures should be undertaken by the states from the perspectives of internal and external legitimacy. On the one hand, in terms of internal legitimacy, the government privilege called "super node" should be granted within the blockchain, and some restrictions should be imposed on the automated decision of the private arbitration system; On the other hand, in terms of external legitimacy, a cooperation mechanism between the blockchain online arbitration system and traditional judicial system based on the types of cases should be established. At the same time, international dialogue should be conducted to promote the establishment of a global consensus mechanism. China should strengthen its research on the standards related to the "judicialization" of blockchain, actively participates in international dialogues, enhance international discourse power and rule-making power, and promote the development of legislation at digital age with a more equitable direction.更多还原
