【摘要】 为保证宪法的全面实施，应在全国人大常委会《关于完善和加强备案审查制度的决定》的基础上细化对司法解释合宪性审查的规定。在确定审查对象时，合宪性审查应排除最高人民法院的指导性案例和两高的工作文件，排除地方两院制发的司法解释性质文件；在设计审查程序时，应将审查的重点放在司法解释发布之前的制定环节，此时全国人大常委会应尊重最高院在制定司法解释中的主导地位。司法解释发布后，审查机关应通过合宪性解释、沟通协商、提出修改议案、废止法律或撤销司法解释等方式敦促最高院修改违宪的司法解释；在理论上，司法解释的合宪性论证过程也是最高人民法院作为解释者、监督者和答复者与包括全国人大常委会在内的各机关展开宪法对话的过程。在这一过程中，应依据司法解释的具体内容和违宪可能性的大小，设计不同的过滤分流和审查处理程序，以实现权利救济和法秩序统一之间的平衡。更多还原

【Abstract】 To ensure the full implementation of the Constitution, it is crucial to refine the provisions for reviewing the constitutionality of judicial interpretations based on the Decision on the Recording and Review System. When determining what should be reviewed, it is important to exclude guiding cases of the Supreme People’s Court(SPC), working documents of the SPC and the Supreme People’s Procuratorate(SPP), as well as documents of judicial interpretation nature by local courts and procuratorates. In terms of the review process, the focus should be placed on the formulation of judicial interpretations before their release. During this stage, the Standing Committee of the National People’s Congress(NPCSC) should allow the SPC to play a dominant role. After the release of the interpretation, the NPCSC should encourage the SPC to correct unconstitutional interpretations through methods such as presuming a constitutional reading, engaging in communication and negotiation, proposing alternative bills, amending laws, or nullifying the interpretation and so on. Theoretically speaking, the constitutional review process can be perceived as a form of inter-institutional dialogue. The SPC, acting as an interpreter, supervisor, and respondent, engages in a constitutional dialogue with the NPCSC and other authorities. Different filtering and review procedures should be designed based on the content of the interpretation and the likelihood of constitutional breaches.
