【Abstract】 Punitive damages system is in danger of being abused in theoretical circles.So,this paper first analyzes the three views of the legal field property of the punitive damages system: civil law system,quasi-criminal penalties and economic law system.And then it advocates that the social property is the punitive damages system’s basic legal property—a feature in the economic law field.Finally,it makes a thorogh analysis of the social property—the punitive damages system’s legal property from the root causes of the system,the function,the restrictions and other aspects.更多还原
