【摘要】 数字经济催生出新的音乐作品创作样态，混音创作成为数字环境下的一种潮流。然而，我国现行版权许可制度在混音创作的治理方面疲于应付。为有效治理混音创作、促进混音市场的有序化发展，学界对此提出了诸多解决方案。美国合理使用“四要素”的判断标准在目前著作权体系下仍存在局限性，知识共享协议效力未定，无法满足混音创作实际需求，法定许可制度对混音创作存在负激励作用，难以应对混音创作授权的现实困境。借助民法领域的默示行为理论构建混音创作领域的“选择退出”默示许可制度，使得作品权利的授予以默示的方式作出，可以降低版权交易许可成本，推动混音创作市场繁荣发展。更多还原

【Abstract】 The digital economy has given birth to new forms of music creation among which mixing creation has become a trend. However,the present copyright licensing system in China is struggling with the copyright governance in mixing creations. In order to solve this problem and promote the development of mixing market in an orderly manner,scholars have proposed many solutions. The criteria of fair use under a“four-factor”balancing test in the U.S. show limitations under the current copyright system because the undefined effect of Creative Commons License fails to satisfy the needs of mixing creation and because the negative incentive of statutory licensing system for mixing creation makes it difficult to deal with the practical dilemma of licensing.Therefore,on the theoretical basis of implied behavior in civil law,an opt-out implied license system for mixing creation is constructed so that the granting of rights to works is made impliedly,which can reduce the cost of licensing copyright transactions and promote the prosperity of the mixing market.更多还原
