【Abstract】 Although mitigated penalty is provided in Article 63 of the 1997Criminal Law,there are some disputes about how to understand and apply this provision.Therefore,this provision has not been effective in practice.By comparing the unamended and amended copies of the 1997 Criminal Law,taking cases published by the Supreme People’s Court as the angel of view,some detailed applications under special circumstances and measurements of the perfection of the 1997 Criminal Law are discussed in this article.更多还原
