大萧条时期美国集体谈判制度的建构及其启示
On the Construction of the Collective Bargaining System during the Great Depression in the United States and Its Implications for China
【摘要】 美国1929年爆发的经济危机导致其劳动法制的全面转型,其中建构的集体谈判制度在一定程度上矫正了劳资关系失衡的格局,对治理经济危机起到了很好的效果。在国际金融危机的背景下,中国有必要通过集体谈判建立劳动关系协调机制,提升对劳动者权益的保护水平,保障劳动者能够分享社会经济发展成果。
【Abstract】 The economic crisis in 1929 in the United States led to a comprehensive transformation of its labor law,and to some extent,the collective bargaining system constructed at that time corrected the imbalance of the industrial relations,which had had a good impact on coping with the economic crisis at that time.In the current context of the international financial crisis,it is of great need for China to establish the industrial relations co-ordination mechanism through collective bargaining to ensure that all the laborers can share the benefits of the socio-economic development.
