【摘要】 随着知识经济的不断发展，知识产权在全球经济竞争中愈显关键。在经济全球化发展中经济竞争愈发纷繁复杂，知识产权不正当使用导致的垄断行为也日渐凸显。知识产权和竞争政策不仅是国别问题，更是全球性问题。经济全球化使知识产权和竞争政策不再是一个国家内部的法律工具和政策手段。此背景下保护知识产权、限制滥用行为已成为提升经济活力、推动行业创新的重中之重，反垄断法既接受知识产权的合法行使对竞争秩序的合理影响，也会对不正当行使知识产权的行为进行约束与惩处，以保证市场竞争的正常有序开展。为破解全球竞争视角下反垄断法规制知识产权滥用面临的难题，不仅要遵循全球竞争法基本原则，维护自由和公平竞争，还应持续加强规制知识产权滥用的区域性合作。最后，应制定和实施与社会主义市场经济相适应的竞争规则，健全统一、开放、竞争、有序的市场体系。更多还原

【Abstract】 With the continuous development of the knowledge economy, intellectual property rights have become more and more critical in global economic competition. In the development of economic globalization, economic competition has become more and more complex, and monopolistic behaviors caused by the improper use of intellectual property rights have become increasingly prominent. IP and competition policy were not just national issues, but global issues. Economic globalization has made intellectual property and competition policy no longer legal and policy tools within a country. In this context, protecting intellectual property rights and restricting abuse have become the top priorities to enhance economic vitality and promote industry innovation, and the Anti-Monopoly Law not only accepts the reasonable impact of the legal exercise of intellectual property rights on the competition order, but also restricts and punishes the improper exercise of intellectual property rights to ensure the normal and orderly development of market competition. In order to solve the problems faced by anti-monopoly regulations and IP abuse from the perspective of global competition, it is necessary not only to follow the basic principles of global competition law and safeguard free and fair competition, but also to continuously strengthen regional cooperation on IP abuse. Finally, we should formulate and implement competition rules that are compatible with the socialist market economy and improve a unified, open, competitive and orderly market system.更多还原
